Abstract

In the 2024 OECD Regulatory Policy Outlook, South Korea ranked first globally in the field of regulatory impact assessment (RIA). Despite this achievement, concerns remain that the current evaluation mechanisms for regulation-related legislation are not functioning effectively in actual legislative processes. This study revisits the conceptual foundations and historical development of Korea’s regulatory legislative impact assessment (RLIA) system and analyzes its institutional configuration as of 2025. It also presents key reform proposals for improving the coherence and effectiveness of the system. Originally developed as a tool for economic analysis of government regulations, the RIA system has evolved into a broader methodology for evaluating state actions of a regulatory nature, regardless of their formal origin or legal format. A comparative legal analysis of the RLIA systems across jurisdictions confirms that RIA and legislative impact assessment (LIA) are essentially unified in design and function. However, in South Korea, RIA and LIA are operated separately under different legal frameworks. RIA is conducted under the Framework Act on Administrative Regulations, led by the Office for Government Policy Coordination with support from the Korea Development Institute and the Korea Institute of Public Administration, whereas LIA is administered under the Framework Act on Administrative Affairs, supervised by the Ministry of Government Legislation and delegated to designated institutions. This institutional fragmentation is further compounded by the temporal divergence in implementation: while RIA is structured as an ex ante mechanism, LIA is generally applied ex post. Moreover, with the 21st National Assembly proposing an amendment to the National Assembly Act to introduce a pre-legislative impact assessment procedure for member-initiated bills with regulatory characteristics, there is growing concern over the potential long-term fragmentation and inconsistency of the impact assessment regime. Key challenges facing the current system include the need for legal codification of ex post regulatory reviews, enhanced collaboration with competent ministries to ensure the effectiveness of LIA, and the concretization of subordinate legislation. The proposed legislative impact assessment system under the National Assembly Act must also integrate and build upon prior evaluation results accumulated by the Korea Legislation Research Institute and pilot projects conducted by the National Assembly Research Service. Moving forward, institutional cooperation among specialized agencies, functional linkage with the existing LIA under the Framework Act on Administrative Affairs, and the methodological refinement of assessment tools are essential. Only through such a coordinated and strategic approach can the RLIA system be established as a coherent and effective mechanism for improving legislative quality and regulatory governance.
