이 연구의 목적은 민원배심제에 관한 의미 재고와 함께 지역사회 갈등조정을 위한 정책적 함의를 찾는 데 있다. 갈등조정 과정에 전문적이고 중립적인 ‘제3자 집단’ 형태의 민원배심제를 통한 조정협상은 양 갈등 당사자에게 신뢰를 줄 수 있다. 또한, 행정기관으로서는 갈등조정 과정에 야기될 수 있는 불필요한 오해나 억측 등에 대한 부담을 줄일 수도 있다. 이러한 민원배심제는 독특하고 흥미로운 제도이다. 그러나 우리의 경우 집단민원과 관련한 민원배심제 채택 연륜이 길지 않아서 그런지 관련 연구가 많지는 않다. 여기서는 관련 문헌과 대략 지난 10년 동안의 대구 수성구 민원배심제 운영 회의자료 분석을 토대로 지역사회 갈등 조정기구로서의 민원배심제의 특성 그리고 그 적용성과 한계 등에 관해 밝혔다. 이를 통해 관련 정책적 함의로서 민원배심제의 보완적 기구성 측면, 운영상의 확장성과 탄력성 측면, 직･간접적 효과 확대 측면 등을 제시한다.
Abstract
When it comes to conflict mediation in the community, the civil complaints jury system is unique and interesting system. Mediation negotiations through a professional and neutral "3rd party group" form of a civil complaints jury can give confidence to both parties in the conflict. Administrative agencies have the advantage of being able to free themselves from the burden of unnecessary misunderstandings and conjectures. Although the significance or role of the civil jury system for complaints related to collective complaints could be considerable, there are not many studies on the relevant issues. It is meaningful to try to reveal the applicability and limitations with the study of the relevant literature and the analysis of the data of the Daegu Suseong-gu Civil Complaints Jury System operation meeting for about the past 10 years. This study presents the policy implications such as the complementary mechanism of the Civil Complaints Jury, the operational scalability and resilience aspects, and the expansion of direct and indirect effects.
