Abstract
The U.S. Court of Appeals for the Federal Circuit (CAFC) in Uniloc has absolutely rejected 25 percent rule, which had been often adopted in calculating reasonable royalty damages for patent infringement. The ground based on the rejection was that the 25 percent rule is a fundamentally flawed method for determining a baseline royalty rate as a starting point in a hypothetical negotiation because that baseline royalty rate is not carefully tied with market evidence to show the value of the alleged patented invention. This article carefully analyzed the fact of the Uniloc and reviewed what was main and strong objection in applying the 25 percent rule. Based on the analysis of the Uniloc this article suggested a proper role of the 25 percent rule in calculating reasonable royalty damages for patent infringement in Korea after considering the feasibility regarding application of applying the 25 percent rule. As a result of the careful analysis and review, this article has found a problem in applying the 25 percent rule to have currently been applied for determining a baseline royalty rate and a main issue had been the method of how the value between the patented invention and non-infringing patented invention can be allocated when the alleged infringing product was complex product. That is, it was apportionment. In the U.S., however, the concept of apportionment has never been seriously considered at least until before 10 years in calculating damages for patent infringement. In this regard, it may be necessary to consider the rejection by CAFC of the 25 percent rule again because CAFC now demands that a patentee apportion the value that the patented invention has contributed to the value of the alleged infringing product, depending on fact pattern of each case, and what the apportionment would be is still contentious issue. In 2019, the Congress of Korea revised Article 128(5) of the Korea Patent Act to award compensatory damages based on a “reasonable” royalty rather than a “established” royalty. Accordingly, it is very important to develop a practical understanding of the 25 percent rule in determining the baseline royalty rate as a starting point for assessing a reasonable royalty rate because Korean courts do not have enough precedents, which have addressed appropriateness regarding methodologies being able to be applied in calculating reasonable royalty damages, depending on a variety of facts and circumstances. There cannot be hard-and-fast substantive rule to measure correct damages because it requires case-specific and fact-specific analysis. When proper quantitative data, such as prior comparable license agreements associated with the alleged patented invention, cannot be provided by parties-in-suit to determine a baseline royalty rate, this article asserts that the 25 percent rule can provide useful framework for a patentee to logically starts assessment of a reasonable royalty rate by adopting 25 percent as a starting point, which can be refined by considering and weighing Georgia-Pacific fifteen factors that provide a essential framework for determining reasonable royalty damages. Additionally, this article strongly suggests that under recognition that the 25 percent rule is still valid, the apportionment ratio be calculated to reflect the value of only the alleged patented invention apart from the assessment of the reasonable royalty rate.
