비밀정보기관의 직무활동 범위 및 한계 설정과 국민의 기본권 보호방안 - 독일과의 비교법적 연구를 중심으로-

비밀정보기관은 적과의 정보전쟁에서 국가를 수호하고 민주적 기본질서를 보호하는데 본연의 임무가 있다. 그 과정에서 물리적 수단을 사용하여 국가안보에 위협적인 요소를 사전에 제거한다. 정보기관이 위험예방을 위해 사용하는 경찰에 고유한 임무는 때때로 정치적 반대세력을 감시하는데 남용되기도 한다. 그 동안 국정원은 불법행위 또는 권한남용을 해온 사실이 검찰수사 및 법원재판에서 밝혀졌다. 비밀정보기관이 국가안보가 아닌 특정 정권의 이익을 위해 동원되고 민주주의 가치를 심각하게 훼손하는 일이 종종 발생하고 있지만, 비밀주의의 상징인 정보기관을 통제하는 일은 쉽지 않다. 비밀정보기관에 대한 민주적 통제의 실패는 국민의 기본권 침해로 이어진다. 따라서 비밀정보기관이 헌법 질서에 순응하여 법치국가적 자유질서에 부합하게 행동하고 국민에 대한 기본권 보호를 보장하는 기구가 될 수 있도록 하여야 한다. 기본적으로는 의회와 정보기관 사이에 긴밀한 협력관계가 이루어지고 있고, 의회에 의한 민주적 통제가 이루어지는 독일의 법제도로부터 시사점을 삼고자 한다. 독일의 연방헌법재판소도 비밀정보기관의 역할을 인정하면서도 국민의 기본적 법익을 보호하기 위해 정보기관의 직무범위설정에 한계를 두고 있다. 이는 기본권 보호 측면에서 비밀정보기관의 활동에 대한 법치국가적 제한이라고 볼 수 있다. 우리나라에서도 비밀정보기관이 기본권 존중의 원칙을 준수하면서 활동할 수 있도록 실효성 있는 통제가 필요하다. 특히, 국정원 개혁은 국민의 기본권과 민주적 통제 강화를 위한 방향으로 공감대가 형성된 부분에 대해서는 우선적으로 입법개선이 이루어져야 할 것이다. 비밀정보기관은 효율적 업무의 수행을 위해 변화하는 대외적 환경에 적응하여 본연의 기능을 수행할 필요가 있다.
Abstract
The secret intelligence agency has its own mission in defending the nation and protecting the democratic basic order in the intelligence war against the enemy. In the process, the intelligence agency uses physical means to eliminate threats to national security in advance. The intelligence agency's activities to prevent risk are sometimes abused to monitor political opponents. The prosecution's investigation and court trials revealed that the National Intelligence Service has been illegal and abusing its authority. But it is not easy to control the intelligence agency, a symbol of secrecy. The failure of democratic control over secret intelligence agencies leads to infringement of people's basic rights. Therefore, it should be allowed to become an organization that conforms to the constitutional order and guarantees the protection of basic rights of the people. As in the case of Germany, basically, close cooperation must be made between Congress and the intelligence agency, and democratic control should be made by Congress. Germany's Federal Constitutional Court also recognizes the role of secret intelligence agencies, but puts limits on setting the scope of duties of intelligence agencies to protect people's basic rights. This can be seen as a national limitation of the rule of law on the activities of secret intelligence agencies to protect basic rights. In Korea, effective control is needed so that the secret intelligence agency can act while adhering to the principle of respect for basic rights. In particular, the reform of the NIS should be reformed in a way to strengthen the people's basic rights and democratic control by Congress. The secret information agency needs to adapt to the changing external environment and perform its original functions in order to perform its tasks efficiently.
