로크는 합리론의 진영에서 보편적인 근대적 주체를 확립한 데카르트와는달리 개인의 자서전적인 기억에 기초한 새로운 근대적 주체 개념을 열어준다. 그는자신의 새로운 근대적 주체 개념을 확립하기 위하여 인격동일성의 문제를 심도 있게 다룬다. 로크에게서 인격의 동일성은 단지 데카르트에게서처럼 논리적인 사유의동일성을 의미하는 것이 아니라 시간과 경험의 흐름 속에서 만들어지고 형성되어나가는 동일성을 의미한다. 그리고 여기에서 기억은 결정적인 역할을 한다. 그렇기때문에 데카르트는 인격 또는 사유하는 주체의 동일성을 문제 삼을 때 기억의 기능을 고려하지 않았던 반면에 로크는 기억을 인격동일성의 중심축으로 간주한다. 이와 같은 관점에서 볼 때 로크에서의 개인의 정체성은 자신의 경험과 회상을 통해 구성되는 정체성이다. 그런데 로크에 있어서 인격 동일성 개념은 단지 근대 인식론적인 차원에서 이론적으로만 접근되는 개념이 아니라, 근대적 개인의 확립을위한 실천적이고 법철학적인 함의를 지니고 있다. 그는 기억 개념에 기초한 자기동일적 인격 개념을 법철학의 영역으로 확장하여 근대적 개인이 자신의 생명과 신체그리고 자산을 소유할 수 있는 권리의 정당성에 대한 실천철학적 근거를 마련하였다. 그리고 이 권리는 자연상태가 아닌 정치사회 또는 시민사회 속에서만 가능하기때문에 로크에게서 기억에 기초한 자기동일적인 인격은 바로 근대 시민사회에서의시민으로서의 개인의 인격 개념으로 이어진다. 이 관점에서 우리가 주목해야 할 사실은 로크는 자신의 이론철학과 실천철학을 관통하는 인격 동일성 개념을 통해 근대적 개인의 자유와 소유, 동의와 합의 그리고 정치적 권력의 필연적 관계를 확립했다는 점이다
Abstract
Locke discloses the novel concept of modern subject, which is based on the episodic memory of the individuals by differentiating himself from Descartes, who lays a ground for modern universal subject in the realm of rationalism. He deals with the concept of the self-identity of person in depth in order to establish this concept of modern subject. For Locke, the personal identity is formed in succession of experience in time, whereas for Descartes, it refers to the identity of logical thinking. Thus in the theory of the identity of person or thinking subject, Descartes does not take the concept of memory into consideration, but Locke conceives the memory as a pivotal concept. In this respect, we can say that for Locke, the personal identity of the individual is grounded by his or her own experience and memory. Owing to this theory, he lays a ground for the theoretical foundation of the modern liberalistic concept of the individual. It should be, however, worth noting that Locke prepares the justification of the property right of the life, body, and the estate of modern individuals on the basis of the personal identity, which is formed by memory. It shows that for him the personal identity is presupposed also in the practical and forensic realm. Moreover, the property right of the individual is acquired only not in the state of nature, but in the political society, i.e., civil society, so that the self-identical person is conceived of as the person, who is regarded as the citizen in modern civil society. In this respect we should take into consideration that Locke established the necessary connection between the freedom, property, consent, compact, and finally the political power of modern individuals in his theoretical and practical philosophy.
