하버마스의 자율성 논변 분석 - ‘유전자 결정론’ 비판을 넘어서 -

본 논문의 목적은 자유주의 우생학자들의 비판과는 달리 하버마스의 자율성 논변이 ‘유전자 결정론’이라는 그릇된 가정에 근거하지 않는다는 것을 논증하는 것이다. 하버마스의 ‘자율성 논변’ 중 자율성과 평등성을 출생의 자연적 우연성과 결부시키는 ‘출생의 자연적 우연성 논증’은 유전자 결정론이라는 그릇된 전제에서 비롯된 것이라는 비판이 자유주의 우생학자들로부터 지속적으로 제기되어 왔다. 그런데 미래 자녀에 대한 우생학적 개입이 직접적으로 자율성을 침해하는 것은 아니라 하더라도 간접적으로는 자율성을 침해한다는 하버마스의 주장, 우생학적 개입을 결정한 부모와 그 개입을 받은 자녀 모두 자녀의 삶의 역사의 단독 저자가 아닌 공동 저자가 된다는 하버마스의 주장 등을 고려한다면, 출생의 자연적 우연성 논증은 유전자 결정론에 근거한다고 볼 수 없을 뿐만 아니라, 자유주의 우생학자들은 자신들의 입장에 대한 하버마스의 비판을 유전자 결정론이라는 공격하기 쉬운 상대로 환원해버렸다는 점에서 ‘허수아비 공격의 오류’를 범한 것이라고 평가할 수 있다. 그러나 자율성 논변은 독립적이고 자기충족적인 논변이라기보다는 종의 윤리 논변에 의존적인 논변이라고 평가될 수 있고, 미래 자녀의 합의 가능성 논증에서 추정 동의가 치료를 넘어 적어도 향상의 일부로 확장될 수 있는 가능성을 배제할 수 없기 때문에 안정적이고 완전하다고 평가되기는 어려울 것이다. 따라서 하버마스의 자율성 논변은 유전자 결정론이라는 비판을 넘어설 수 있지만, 어떠한 이론적 문제도 남겨 놓지 않은 ‘강력한 논증’으로 평가되기는 어려울 것이다.
Abstract
The purpose of this paper is to demonstrate that, contrary to criticism from liberal eugenics advocates, Habermas’s argument from autonomy is not based on genetic determinism. There is constant criticism from liberal eugenics advocates that Habermas’s argument from the contingency of one’s procreation is based on genetic determinism. But, considering Habermas’s claim that the parents’ decisions on their child’s genetic makeup might indirectly have an adverse effect on the sense of their child’s autonomy, and that the parents and their genetically programmed child become co-authors of his or her life history, Habermas’s argument from the contigency of one’s procreation is not based on genetic determinism. Furthermore, liberal eugenics advocates commit the fallacy of straw man, because they regard Habermas’s criticism of their position merely as genetic determinism. Yet, Habermas’s argument from autonomy cannot be regarded as an independent argument, because it is dependent on his argument from ethics of the species. In addition, Habermas’s argument from autonomy cannot be regarded as a complete argument, because the genetically programmed child will partly agree to enhancement beyond therapy. Thus, Habermas’s argument from autonomy cannot be regarded as a knock-down argument, though it is not based on genetic determinism.
