국회의 이민정책 결정과 정당정치: 제18대 국회를 중심으로

한국에서 외국인근로자나 결혼이민자 등 이민인구가 증가하면서 국회는 다문화사회에 대응하기 위한 다양한 법안을 의결하였다. 이 연구의 목적은 제18대 국회에서 이민정책 관련 법안의 개정을 중심으로 이민정책의 변화를 살펴보고, 원내정당 간 정책선호에 차이가 있는지를 본회의 표결자료에 근거하여 분석하는 데 있다. 분석 결과, 대부분의 이민정책 관련 법안은 높은 찬성률로 의결되어 원내정당 간 정책선호에서 큰 차이를 발견하기 어려웠다. 그 이유는 이민자에 대한 지원 및 복지 등 이민자통합에 초점을 맞춘 이민정책, 이민자 지원에 우호적인 여론, 중도에 치우친 원내정당의 정치적 스펙트럼 등을 들 수 있다. 그런데 연구 대상 법안 중 원내정당 간 정책선호 차이가 발견된 것으로, 외국인 출입국 시 지문과 안면정보 제공을 의무화한 「출입국관리법」 개정안과, 복수국적을 제한적으로 허용하는 「국적법」 개정안이 있다. 통계분석 결과, 두 법안에 대한 표결에서 국회의원의 소속정당과 이념성향, 선수 등이 영향을 미친 것으로 나타났다. 두 법안 모두 야당인 민주통합당 의원들의 반대투표가 두드러졌고, 보수적인 의원일수록 찬성투표를 하였다. 요컨대, 대한민국 국회의 이민정책 결정과정에서 원내정당 간 정책선호는 상당히 수렴되어 있으며, 외국인 인권문제와 같이 이슈의 현시성이 두드러진 경우에만 정당 간 입장 차이가 드러난다.
Abstract
As the number of immigrants increases, the Korean National Assembly (KNA) has legislated a lot of immigration policy. The purpose of this paper is to investigate the immigration policy changes in the 18th KNA, and to analyze the policy preference of legislative parties based on the roll call voting data. The immigration policy changes are focused on the support of marriage-based immigrants and their children, and their integration into Korean society. Due to this policy contents, legislative parties show high level of consensus in legislation of immigration policy. Members passed immigration bills by a unanimous vote or with high approval rate. The legislative parties, however, had rival positions on amendments of the two bills: one is the Immigration Control Act (taking the fingerprints and the face-picture of new arrival foreigners), the other is the Nationality Act (permitting multiple citizenship). Party and political spectrum influenced Members’ voting decision. Ruling party (the Grand National Party) assented the amendment, while opposition party (the Democratic United Party) disapproved them. And, conservative Members assented the amendment. In conclusion, policy convergence of the legislative parties is observed in most of immigration policy making so long as the contents of the bills are related with noncontroversial issues such as immigrant’s human rights.
