지방 분권이 민주주의 발전을 촉진하기 위해서는 개인의 자유와 자유로운 개인의 존재라는 전제에서 출발해야 하며, 지역 차원에서 이 자유는 중앙으로부터의 소극적 자유뿐만 아니라 중앙에 대한 적극적 자유까지 포괄한다. 더 나아가 현대의 지방 분권 흐름은 정치적 민주주의뿐 아니라 사회 경제적 민주주의와 일상의 민주주의까지 흡수할 때 설명 가능하다. 하지만 이러한 방향으로 작동하려면 다음과 같은 요건이 갖추어져야 한다. 첫째, 분권화 권력의 주체인 주민이 지역 민주주의를 실현할 수 있는 의지와 능력을 갖추어야 하며, 지역 경계 설정이 주민의 생활 패턴과 지역 공간에 조응하는 정치적 가치를 구체화하는 방식으로 이루어져야 한다. 둘째, 분권화 권력의 범위가 지역 정부 형태에 이르기까지 지역 사안에 대한 포괄적인 결정권과, 지역과 결부된 중앙 정부 정책 및 전국적 사안에 대한 참여를 포함해야 한다. 셋째, 자치 실현의 자원인 지역의 사회 경제적 기반이 민주주의의 유지와 발전을 위해 적절한 수준에 도달해야 한다. 이 세 요건은 분산과 위임을 넘어 이양의 단계에서 충족될 수 있으며, 이와 같이 높은 단계의 분권은 지역 간 갈등을 완화하거나 해소해 국가의 민주적 통합을 촉진하는 ‘분권에 의한 통합’을 가능하게 한다.
Abstract
The decentralization should start with the premise of the individual freedom and the existence of free individuals to promote the democratic development, and on the regional level this freedom includes not only passive freedom from the center but also active freedom for the center. Moreover, the modern trend of decentralization can be understood when it is explained not only with political democracy but also with socioeconomic and lifestyle democracy. The decentralization can operate in this direction if the following requirements are met. First, the community as the subject of decentralized power should have the will and ability to realize regional democracy and the boundary setting of community should embody the political values consorting with the pattern of life and the regional space. Second, the scope of decentralized power should not cover only comprehensive decision making on regional issues including the type of regional government but also participation in central government policy-making and national issues related to the region. Third, the socioeconomic foundations of the region must reach an appropriate level for the maintenance and development of democracy. These three requirements can be filled on devolution, beyond deconcentration and delegation. And such a high-level decentralization makes ‘integration by decentralization’ facilitating democratic integration of the nation through easing or resolving conflicts between regions.
