게임물에 대한 사전심의제도로 인하여, 한국의 앱스토어에는 게임 카테고리가 없다. 스마트폰용 게임콘텐츠 개발의 활성화와 게임콘텐츠에 대한 사전심의 제도의 필요성을 모두 고려해 본다면, 사전심의의 주체를 준행정기관이 아닌 민간자율심의기구로 변경하는 방안을 고려할 수 있다. 게임법의 ‘사행성’을 사행행위법의 ‘사행성’ 및 형법상의 ‘도박’ 보다 넓은 개념으로 해석할 경우 표현의 내용에 대한 사전검열이 되므로 동일한 개념으로 해석하는 것이 바람직하다. 게임물등급위원회의 등급분류거부 제도의 위헌 여부와 관련하여, 만약 게임물등급위원회의 사전심의가 민간의 자율심의로 전환되거나 게임물등급위원회 자체가 순수 민간자율심사기구로 전환된다면, 위헌 가능성이 낮아질 것으로 사료된다.
Abstract
Because of the preliminary review on the game contents, there is no game category in the korean app-store. For the development of game contents of smartphone and necessity of the preliminary review on the game contents, we could consider a method that the subject of the preliminary review should be replaced by a private deregulated organization. To avoid the controversy of unconstitutionality as for pre-inspection, ‘speculation’ in the Game Industry Promotion Act should be interpreted as the same concept of that in Act on Special Cases concerning Regulation and Punishment of Speculative Acts, etc. and ‘gambling’ in Criminal Act. Regarding unconstitutionality of Provisional Rating Rejection system of Game Rating Board, the possibility of it's unconstitutionality would decrease, if the subject of the preliminary review was replaced by a private deregulated organization.
