EU는 지난 반세기에 걸친 법적, 제도적 발전을 통해 양성평등의 실현을 위한 정책적 기반의 구축에 있어 국제사회의 선도적 위치를 점하고 있으며, EU의 양성평등정책은 또한 전반적으로 발전의 속도가 더딘 것으로 평가되고 있는 EU 사회정책의 제반 분야 가운데 예외적인 성공사례인 것으로 간주되고 있다. 본 연구는 EU의 양성평등정책이 국제적인 모범사례인 한편 EU 사회정책 분야에서 가장 괄목할 만한 진전을 보이고 있다는 점에 주목하여, EU의 양성평등정책이 어떠한 제도적 환경 속에서 어떠한 법적 기제를 통해 추진되고 있는지를 살펴본다. EU의 양성평등정책이 성공적으로 추진되고 있는 것은 EU 설립 조약에서 제공하고 있는 법적 근거를 기반으로, 정책 입안을 담당하고 있는 EU 집행위원회와 양성평등정책과 관련된 이해 당사자인 여성 단체 및 여성 관료들이 적극적 입법 활동을 전개했기에 가능한 것이었으며, EU 법의 적극적 해석에 근거한 판결과 심사를 통해 EU 양성평등정책이 실질적 효력을 발휘할 수 있도록 하고 있는 유럽사법재판소의 역할에 힘입은 바가 매우 큰 것으로 나타나고 있다.
Abstract
EU's gender equality policy not only boasts the most progressive features among international entities that encompass international organizations and nation states, it also represents the most successful case of policy development in the area of social policy in the EU. Drawing on the substantial progress the EU has made in the area of gender equality, this paper examines the institutional environment and legal mechanism of EU on the basis of which gender equality policy could develop in such an impressive pace. It finds that the success of EU in the field of gender policy can be attributed to a large extent to the commitment to the cause on the part of gender advocates, “femocrats” of EU, and other political leaders that feeds into the increasingly favorable institutional environment, and to the determination of the European Court of Justice to play an active role in interpreting and clarifying the letters of EU law in an expansive manner.
