여성정책에서 성평등정책으로? 젠더정책의 오해와 이해

이 글은 2015년 「양성평등기본법」의 시행을 계기로 한국사회 젠더정책의 구현 과정에서 나타난 문제점을 살펴보고 그 해결 방향을 논의하는 데 목적이 있다. 성평등의 실현을 목적으로 하는 젠더정책은 성별 불평등의 인식에 기초한 차별의 프레임에서 출발하여 정책의 사회적 맥락에 따라 성평등의 정의와 목표, 전략을 규정한다. 한국사회에서는 1980년대 이래 부녀정책에서 여성정책으로, 양성평등정책으로 발전되어 왔으나, 차별의 프레임이 약화됨으로써 성평등정책은 성별 불평등의 해소보다는 여성의 사회참여 기회 확대 쪽으로 중심을 이동해 왔다. 그 결과 2016년 한국사회에서는 그 어느 때보다도 폭발적인 젠더 갈등의 양상이 전개되고 있다. 이 글은 한국사회에 대한 맥락적 성찰성을 토대로 ‘여성정책’과 ‘성평등정책’ 사이에서 혼란을 겪는 한국의 정책 담론과, 훨씬 더 보수적인 국가의 젠더정책이 직면한 상황을 분석한다. 그리고 EU의 상황―신자유주의 경제위기 속에서 젠더정책이 직면해 온 난관(難關)과 정체(停滯) 양상, 그리고 이 상황을 돌파하기 위한 모색 등―을 검토하며, 사회적 위기와 국가 정책의 틀 속에서 젠더정책의 위치 변화를 규명한다. 이러한 논의를 토대로 한국의 젠더정책이 ‘여성정책’과 ‘성평등정책’이라는 두 개의 목적을 동시에 추구해 갈 수 있는 두 트랙 전략으로 구성되어야 하며, 교차적 차별의 개념에 따라 법제도를 재구성해 가야 할 것을 주장한다.

Abstract

“The Framework Act on Women’s Development”, which was enacted in 1995, has been fully revised as the “The Framework Act on Gender Equality” in 2015 after 19 years. Just as the framework of women’s policies on a global scale has evolved from the politics of identity to the politics of difference and the transformation of gender relations, women’s policy has expanded to afformative action and gender mainstreaming in Korea. In this policy development, “The Basic Act on Gender Equality” has been born. The purpose of this paper is to examine the various problems caused by the transition from women’s policy to gender mainstreaming frame through the implementation of the Basic Act on Women’s Development and to find the solutions. To this end, we will discuss the recent development of gender policy in western societies such as the EU, examining the difficulties and stagnation faced by gender policies in the neo-liberal economic crisis, and seeking to break through this situation. Based on these discussions, we propose a two-track strategy for gender policy in Korea that can simultaneously pursue two objectives: women’s policy and gender equality policy.
