Abstract
This study examines the main challenges faced by the UK government in designing and implementing its trade policy in the context of Brexit. In particular, this study reviews how the UK government has set up its legal trade infrastructure such as ministry of trade and analyzes its efforts of newly negotiating free trade agreements (FTA) that have been already implemented under EU’s trade policy. The UK government first established the Department of International Trade (DIT), and introduced legislations in order to carry out its own trade policy. On the basis of this, the UK Government has finalized its concessions for trade in goods and services and notified them of the WTO. In bilateral trade relations, the UK government has put a priority on the succession of the EU's FTAs. To this end, it successfully negotiated with the FTA partners and concluded 18 FTAs as of December 2019. The following factors allowed to the UK government to negotiate quickly trade deals. First, the EU’s trade partners were favorable to the negotiation with the UK in order that they can continue a preferential trade relationship with the UK. Second, the UK and its trade partners used a method of negotiation, mutatis mutandis, using EU’s existing trade agreement rather than starting negotiation from the zero. In addition, the EU has shown its cooperative stance on the succession of its FTAs by the UK. On the other hand, as the negotiations focused on ensuring the continuity of preferential trade, there may be some problems, when interests of the EU, the UK, and third countries start to diverge, particularly from a legal point of view. Besides, the economic and trade relations between the UK and the EU have not yet to be determined. This could create uncertain conditions for implementing the UK’s FTAs in the future.
