브렉시트 상황과 EU의 아시아 국가에 대한 국제통상법 패러다임 변화

EU는 다자간 무역체계인 WTO의 규범에 대한 존중과 동시에 한-EU FTA 이후 아시아 국가들과의 특혜무역협정을 체결하려고 노력하고 있다. 이 과정에서 EU는 지속가능성과 무역을 연계하는 등의 이른바 ‘유럽의가치’를 반영하려고 한다. EU는 브렉시트(Brexit)로 인한 변화를 겪고 있으며, 이러한 상황은 EU와 영국의 아시아 국가들에 대한 통상법 틀에도변화를 줄 것이다. 한-영 FTA는 브렉시트라는 변수가 EU와 그 외 유럽권의 특혜협정 확대를 자극하는 사례라고 평가된다. 영국과 EU는 서로다른 기준으로 아시아 국가들과 국제통상법을 구축하고자 할 것이기 때문이다. 국제통상법의 트렌드에 따라서 EU와 영국의 새로운 관계를 설정하는 협정이 체결된 것처럼, 미래의 한-영 FTA는 종합적인 경제협력에관한 조약으로 발전하면서 한-EU FTA와는 다른 모습으로 변화할 것이다. 한-EU FTA가 아시아 지역의 국가들에게 EU와의 특혜협정 체결을유도하는 자극제가 되었던 것처럼, 브렉시트 상황과 한-영 FTA 등의 체결은 아시아 국가들에게 새로운 특혜협정의 체결을 유도하고 있다. 나아가 기존에 아시아와 유럽이 서로의 관계를 설정하고 규율하던 다른 국제법들도 그 내용이 변화할 것이며, 새로운 조약들이 체결될 가능성도 충분하다. 이와 같은 변화에 적절하고 신속하게 반응하는 적극적인 태도가 요청되며, 이를 위한 보다 세밀한 연구와 대안의 제시가 필요하다.
Abstract
The EU is trying to establish preferential trade agreements with Asian countries after the Korea-EU FTA. In this process, the EU tries to reflect so-called “European values” such as linking sustainability and trade. The EU is undergoing internal changes due to Brexit, and this situation will also change the trade environment for the EU, the UK and Asian countries. The Korea-UK FTA is considered to be a case in which Brexit stimulates the EU and Europe enlarge preferential agreements, since the UK and the EU will try to establish international trade laws with Asian countries by applying their respective standards. Just as the EU-UK Trade and Cooperation Agreement was signed to establish a new relationship between the EU and the UK in accordance with the trends of international trade law, the future Korea-UK FTA will be changed into a different form from the Korea-EU FTA. Just as the Korea-EU FTA has been a stimulus to induce countries in Asia to sign preferential agreements with the EU, the Brexit situation and the establishment of the Korea-UK FTA are inducing Asian countries to sign new preferential agreements. Furthermore, the content of other international laws by which Asia and Europe established and regulated the relationship between the two will be changed. An active attitude to respond appropriately and promptly to such changes is required, and more detailed research and suggestion of alternatives are required for this.
