탄소배출권 예비분 제도에 관한 연구: 독일의 사례를 중심으로

탄소배출권 예비분(reserve)은 신규진입 등 여러 가지 이유로 인해 배출권 거래제 계획기간 초기에 할당하지 못한 부분을 계획기간 중에 추가 할당해야 할 경우에 대비하여 따로 보유하는 배출권을 의미한다. 예비분은 탄소배출권 거래제 도입초기에 배출권 시장을운영하기 위해 수반되는 배출권 할당제도의 문제점을 보완하고 배출권시장을 안정화시키기 위한 필수적인 요소이다. 본 연구는 독일의 경험을 중심으로 탄소배출권 예비분 제도의 기본적인 운영과정과 문제점을 살펴보고 이를 통해 우리나라의 탄소배출권 제도와 예비분 운영에 대한 시사점을도출하고자 하였다. 본 연구를 통해 한국의 탄소배출권 예비분 운영에 관한 시사점을 요약하면 다음과 같다. 첫째, 독일과 한국은 상당한 제도적 유사성을 지니고 있으므로 한국은 배출권거래제 시행 초기 독일의 경험을 활용할 필요가 있다. 특히 우리나라에서도 신규진입자용 예비분이외에 배출권거래제 초기에 할당의 불확실성과 신규진입자 및 소송 등에 대비한 예비분이 필요할 것으로 판단된다. 둘째, 국가예비분의 부족에 대비하여 독일에서는 공신력있는 기관인 독일부흥은행(KfW)에 배출권을 시장에서 매입할 수 있는 권한을 위임함으로써 운영과정에서의 예비분부족상황에 대처할 수 있도록 하였는데 우리나라에서도 이와 같은 공신력있는 기관을 지정하여 예비분 제도의 운영과정에 참여시키는 것을 검토해 볼 수 있을 것이다. 셋째, 독일의 2기의 예비분 제도에서 보듯 배출권 할당법하에서 예비분의 용도를 명확하게 구분하고 정의함으로써 예비분의 역할을 지나치게 모호하거나 광범위하게 확장함에따라 발생할 수 있는 배출권거래제 시행초기의 혼란을 최소화할 필요가 있다
Abstract
This study analyses the reserve of carbon emission allowances in Germany,including definition of reserve, its operation process and evaluation. And theresults of this study could apply to the management of Korean emission tradingsystem. The main results of this study and implications for Korean emissiontrading system are as follows. First, a fair amount of reserve is needed in the first stage of the Koreanemission trading system from the German unsuccessful experience that Germanreserve was on the low side in the first stage. This reserve will effectivelyprepare for uncertainty and claims in the first stage of the emission tradingsystem. Second, the Korean national authority needs to make some credible institutionsavailable to the competent authority for the allocation of emission allowances, asGerman authority commissions KfW (Kreditanstalt für Wiederaufbau) to buy emissionallowances on their own accounts when the national reserve is exhausted. Third, the laws and the concerning regulations should clarify the definition androle of reserve, scope of installations, allocation methods, and etc as possible as. It can minimize the chaos in first stage of emission trading system as a pilot phase.
