초록

본 논문에서는 EVFTA 내 GI 규정 검토를 통해, EU의 GI 전략과 양자간 GI 협정 이후, 개도국인 베트남 내 GI 규범 변화를 분석하였다. 또한 EU가 최근 체결한 타 FTA(EU-캐나다 CETA, EU-일본 EPA, EU-싱가포르 FTA) 내 GI 체결 결과와의 비교를 통해 EVFTA GI 규범 특징을 분석하였다. 베트남에서의 GI는 소유권과 권리 행사, 권리등록 주체가 국가라는 특징이 있다. 이는 GI의 권리 전체가 국가에 의해 통제된다는 의미이다. 더불어 EVFTA GI 규범 중 주요사항은 EVFTA 발효 이후 10년의 전환 기간 동안 EU 주요 GI에 대한 베트남 내 사용금지가 유예된다는 점이다. 이는 EU가 베트남 측의 규범 발전의 정도를 감안한 조치라 할 수 있다. 첫째, EU와 같이 원자재 공급과 공정을 동시에 특정지역에서 수행하는 상품과 공정만을 해당 장소에서 진행하는 상품을 구분하는 GI 제도를 마련해야 한다. 둘째, ‘한국김치’, ‘고려인삼’ 뿐 아니라 페타치즈의 경우와 같이 김치 그 자체를 등록할 수 있도록 해야 한다. 셋째, WIPO 내 ‘리스본협정 제네바조약’ 등 김치의 국제기구 등록을 추진해야 한다.

Abstract

In this paper, by reviewing the GI regulations within the EVFTA, we analyzed the changes in GI regulations in Vietnam, a developing country, after the EU's GI strategy and the bilateral GI agreement. In addition, the characteristics of the EVFTA GI norms were analyzed through comparison with the results of GIs in other FTAs ​​recently concluded by the EU (EU-Canada CETA, EU-Japan EPA, EU-Singapore FTA). GIs in Vietnam are characterized by the state as the subject of ownership, exercise of rights, and registration of rights. This means that all rights of GIs are controlled by the state. In addition, the main point of the EVFTA GI regulations is that the ban on the use of major EU GIs in Vietnam will be suspended during the 10-year transition period after EVFTA takes effect. This can be said to be a measure taken by the EU in consideration of the degree of development of norms on the Vietnamese side. First, a GI system should be established to distinguish between products that supply raw materials and processes simultaneously in a specific area, as in the EU, and products that only process only in that location. Second, in addition to ‘Korean Kimchi’ and ‘Korea Ginseng’, kimchi itself should be registered as in the case of feta cheese. Third, it is necessary to promote the registration of kimchi with international organizations such as the ‘Lisbon Agreement and the Geneva Convention’ within WIPO.
