리스본조약 이후 공동외교안보정책에 대한 EU 권한의 범위와 한계: 대북한 제한조치를 중심으로

초록

EU 차원에서 채택되는 제3국 및 개인에 대한 제재조치는 크게 두 가지체제, 즉 유엔의 결의를 이행하는 체제와 EU의 독자적 체제로 나뉜다. EU는 유엔 안전보장이사회의 결의에 따라 2006년부터 여러 제재조치를 채택하고 있다. 제제조치를 채택하고 이행하는 EU의 권한에 대해서는 해결해야 할 과제가 적지 않다. 제3국 혹은 개인을 대상으로 한 제재조치의 법적 근거가 오로지 유럽‘역내’시장에서의 사법내무협력(JHA) 혹은 자유안전사법지대(AFSJ)와 관련한 사항(특히, 테러리즘)인가, 아니면 공동외교안보정책(CFSP)에 관련된 사항인가를 판단하는 것은 쉬운 일이 아니다. 또 그에 따라 전자에 관련된 경우에는 TFEU 제75조를, CFSP를 포함한 EU의 대외적 행동에 관련된 경우에는 TFEU 제215조를 적용해야 한다고 단정적으로 결론을 내리기도 쉽지 않다. ‘CFSP'와 ’non-CFSP'의 문제는 사안에 따라 여전히 ‘현재진행형’이고, 또한 그에 따라 TFEU 제75조와 제215조의 어느 조항을 법적 근거로 하여 제한조치를 취할 것인가의 문제도 일종의 ‘회색지대’(grey areas)로 남아있다.

Abstract

The restrictive measures for third countries and individuals adopted at the EU level are largely divided into two systems: a system that implements the resolutions of the United Nations and an independent system of the EU. The EU has adopted several restrictive measures since 2006 under the UN Security Council resolution. There are a few issues that need to be addressed with regard to the EU's competence to adopt and implement restrictive measures. It is not easy to judge whether the legal basis for restrictive measrues against third countries or individuals is solely concerned with matters relating to the Justice and Home Affairs(JHA) or the Area of freedom, security and justice(AFSJ) in the European internal market (especially terrorism) or whether it is related to the Common Foreign and Security Policy(CFSP). It is also difficult to conclusively conclude that Article 75 of the TFEU should be applied in relation to the former and Article 215 of the TFEU in the case of the external actions of the EU including the CFSP. The issue of 'CFSP' and 'non-CFSP' is still 'ongoing', and the issue of whether any restriction of TFEU Articles 75 and 215 is to be taken as a legal basis also remains as 'gray areas'.
