최근 의료수요의 증가에 따른 치과의료사고의 비중이 높아지고 있으며, 진료과실이라고도 하는 치과의사의 책임은 의료책임법의 중요한 측면이라고 할 수 있다. 치과치료시 구강의 발생학적, 생리학적 복합성은 정확한 진단과 치료를 어렵게 만들며, 특히 혈액질환, 간질환, 심혈관계 질환 등 전신질환을 동반한 환자의 경우 치과진료 시 비정상 출혈, 창상치유지연, 감염, 스트레스로 인한 전신반응 등 중대한 합병증의 위험이 상존한다. 본 논문에서는 전신질환을 가진 환자의 치과치료 과정에서 발생할 수 있는 의료사고와 이에 따른 치과의사의 법적 책임 범위를 체계적으로 분석하였다. 치과치료의 진료영역별 주의의무에 대한 최근 판례를 중심으로 정리하고 기존의 연구결과에 이어서 최근 사례들을 반영하고 이와 아울러 사례들 이면에 있는 법적 문제와 예방적 시사점을 도출하고자 하였다. 전신질환자의 치과치료와 관련된 치과의사의 주의의무를 체계적으로 분석하는 것을 목적으로 이와 관련하여 다양한 개별사례에서 치과의사의 책임의 범위와 내용에 대해 검토하고 있다. 이를 위해 우선, 치과치료의 진료영역별 주의의무에 대한 최근 판례를 분석하여 치과 의료책임의 법리를 정리하고 있다. 아울러, 치과 진료 시 문제되는 전신질환의 유형을 의학적 관점에서 검토하고 고혈압, 당뇨병 환자 및 염증 관련 사례를 중심으로 최근 판례를 분석하여 구체적 주의의무의 내용을 도출하고 있다. 마지막으로, 사례 분석을 통해 개별 사례에서 치과의사 책임의 범위와 내용을 법적 쟁점과 예방적 시사점을 제시하고 있다.
Abstract
The proportion of dental malpractice incidents is increasing, particularly due to rising demand for dental care, and the liability of dentists—also referred to as medical malpractice—constitutes a significant aspect of medical liability law. The complex embryological and physiological nature of the oral cavity during dental treatment makes accurate diagnosis and treatment challenging. Particularly for patients with systemic diseases such as blood disorders, liver disease, or cardiovascular disease, the risk of serious complications during dental treatment—including abnormal bleeding, delayed wound healing, infection, and systemic reactions due to stress—is ever-present. This study systematically analyzes medical accidents that may occur during dental treatment for patients with systemic diseases and the corresponding scope of the dentist's legal liability. It focuses on recent case law regarding the duty of care across different areas of dental practice, building on existing research to incorporate recent cases. Furthermore, it aims to derive the underlying legal issues and preventive implications from these cases. The objective is to systematically analyze the dentist's duty of care related to dental treatment for patients with systemic diseases. To this end, it examines the scope and content of the dentist's liability in various individual cases. First, it analyzes recent case law regarding the duty of care by specific areas of dental treatment to systematize the legal principles of dental liability. Furthermore, it examines the types of systemic diseases problematic during dental treatment from a medical perspective and analyzes recent case law, focusing on patients with hypertension, diabetes, and inflammation-related cases, to derive the specific content of the duty of care. Finally, through case analysis, it presents the scope and content of the dentist's liability in individual cases, along with legal issues and preventive implications.
