본 연구는 민주화 이후 자본의 권력이 강화되는 ‘민주주의의 역설’을 주목하고 있다. 본 연구의 목표는 민주주의 체제에서 계급지배가 유지되는 방식을 관계론적인 입장에서 탐색하려는 것이다. 필자는 계급 간 적대가 민주화 이후에도 소멸되지 않으며 민주주의 체제를 구성하는 국가 장치에 삼투되어 드러난다고 본다. 일차적으로 의회에서 충돌한 계급 적대는 의회정치의 불충분성으로 인해 행정관청과 사법관청 등 다른 권력 장치로 이동되었다. 이 글에서 가장 주목하는 ‘행정정치’와 ‘정치의 사법화’는 자본의 지배 전략적 기획으로 시작되어 시민노동세력이 호응한 결과였다. 그러나 인민 통제로부터 자유로운 행정 사법 기관은 결과적으로 계급 편향적 판단을 양산함으로써 계급지배에 기여했다. 전문성과 중립성을 가장한 권력기구들에 의해 계급지배가 정당화되면서 민주주의 체제에서도 계급지배가 유지되는 것으로 볼 수 있다.
Abstract
This study focuses on ‘The Democratic Paradox’ that the power of capital is reinforced after democratization. The aim of this paper is to explore the way in which Class Domination is maintained under democratic regime in relational position. Hostility between classes is not extinguished even under democratic regime and permeated to develop into a national device which constitutes democratic regime. Firstly, class hostility which takes place in Congress was transferred into other power devices such as the administrative office and the judicial bureau due to insufficiency of parliamentary government. Administrative politics and judicialization of politics which are most paid attention to in this paper is initiated by ruling strategic plan of capital and resulted from response of citizen-worker force. But eventually the agency of judicial administration which is free from people’s control was devoted to class ruling by mass-producing class-oriented judgment. As class domination is justified by power structures in the disguise of specificity and neutrality, class domination can be seen to be maintained
