일제강점기 여권 개념과 유교가부장제론 전파에 내재된 국가주의: ‘문중’에서 ‘국가’로 섹슈얼리티 통제장치의 이양

Abstract

From the end of the 19th to the beginning of the 20th century, East Asian society was a period of upheaval, establishing a new political and economic order. During this period, Korea tried to accept the Western concept of law and rights and establish a new order amid the desire to realize the ideal of an “independent state”. The concept of women's rights also emerged in this context, in which the understanding of human relations in the East Asian tradition and a new way of understanding that began to flow from the West are mixed. Looking at the times and uses when women's rights concepts began to be used, it does not link the discussion of promoting women's rights to Confucian criticism. It can be said that the Confucian tradition was called ‘patriarchal’ and began to criticize it when Western sociology was introduced after the liberation of Korea. In this process, when discussing the issue of the family view of Korea or the status of women, the discussion on the aspect of legalizing the hoju system based on Japan's absolute patriarchal power when enacting and revising the Civil Law Family Act during the Japanese colonial period was eliminated, and focused only on the Confucian patriarchal criticism. Looking at the point of inconsistency between the patriarchal theory, the main framework for criticizing Confucianism, which was represented by the traditional values of East Asia during the period of upheaval, and the Confucian values as a principle that constitutes women's lives, this study attempts to criticize the concept of women's rights and the nationalist ideology commonly draped in the Confucian patriarchal theory. This process can be seen as a process in which the subject of sexuality control is transferred from ‘Munjung’ to ‘Nation’.
