해외 사례를 통해 본 경찰 신속 DNA 분석 활성화 방안

경찰청은 2021년부터 범죄의 증거 확보, 범인의 신원확인, 사건의 조기 해결을 위하여 ‘신속 DNA 분석’을도입하였다. 미국 등 일부 국가들은 약 9년 전부터 신속 DNA 분석을 도입하여 운영하고 있다. 본 연구를 통해서 알아본 미국, 네덜란드, 영국, 유럽 ENFSI 등의 예를 보면 신속 DNA 분석을 운영하기 위한 몇 가지 장치들이 마련되어 있다는것을 알 수 있었다. 첫째, DNA 분석의 표준 절차와 대상의 범위에 대한 기준이 확립되어 있을 것, 둘째, 반드시 분석또는 결과 해석에 있어서 전문가를 배치하여 신뢰할 수 있는 결론을 도출할 것, 셋째, 사람으로부터 수집한 시료가아닌 현장 시료에 신속 DNA 분석을 적용하기 위해서 검증 시스템을 갖추고 규정을 마련할 것 등으로 요약할 수 있다. 신속 DNA 분석 기법의 적용 범위가 확대되기 위해서는 전문인력의 배치, 표준 절차 마련과 KOLAS 등을 통한인증, 운영 근거 규정 마련 등이 선행되어야 할 것이다.
Abstract
Since 2021, the Korean police agency have been operating ‘rapid DNA analysis’. Some countries, including the United States, have been operating rapid DNA analysis for about 9 years. Looking at the cases of the United States, the Netherlands, the United Kingdom, and the ENFSI, we could see that several devices have been in place to operate rapid DNA analysis. First, there must be established standards for the standard procedures and scope of DNA analysis, second, experts must be assigned to analyze or interpret the results to derive reliable conclusions, and third, a verification system and regulations must be established to apply rapid DNA analysis to crime scene samples rather than samples collected from people. In order to expand the application of rapid DNA analysis techniques, it is necessary to first assign experts, establish standard procedures, certify through KOLAS, etc., and establish operating basis regulations.
