Abstract
This study examines the admissibility and probative value of Rapid DNA analysis results under the Criminal Procedure Law, focusing on its application as forensic evidence in criminal trials. Rapid DNA analysis significantly reduces the processing time compared to conventional forensic laboratory-based methods and enables non-experts to operate the system, thereby greatly enhancing investigative efficiency. Notably, the ability to obtain DNA results within 90 minutes can play a crucial role in securing early investigative leads in cases such as abductions or violent crimes. However Rapid DNA technology presents has limitations such as mixed sample processing, difficulty in reproducing results, and the interpretation by non-experts. These weaknesses can be an obstacle to securing the scientific reliability of the results and the probative value in court. often leading investigative personnel and forensic institutions to adopt a cautious approach regarding the technology. This paper systematically analyzes the structural differences between traditional forensic DNA analysis and Rapid DNA systems, reviews domestic and international regulatory practices and legislative examples, and considers the judicial stance on scientific evidence in South Korean case law. Based on this analysis, the study proposes several improvements to ensure the admissibility of Rapid DNA results in criminal proceedings. These include the development of standardized operational protocols, the establishment of qualification frameworks for system operators, the standardization of expert report procedures, and the codification of relevant legal provisions.
