Abstract
The exercise of public power includes so-called law enforcement as a practical implementation of normal substance and maintenance of those effects in the public interests. Since legal issues on personal data processing has become the social problem besides in law enforcement instantiated by the prevention and investigation of crimes, indictment and prosecution, facial recognition, which is executed in publicly accessible place for law enforcement purpose as administrative proceedings of criminal justice, can be reviewed as follows from the viewpoint of interpretative theory and legislative corepoint. As facial recognition information is personal data as visualized sensitive biometric feature, it can significantly infringe personal rights of privacy and aggravate discrimination with chilling effects on the freedom of expression and movement and assembly. So shall not be processed at least by specific concrete statutory decrees. And facial recognition for law enforcement purpose consists of compulsory disposition, which is consecutive synthesis combined by three steps; picture-taking step as actual act of powerful fact, image collection step as disposition necessary for inspection, and data analysis step as inspection. While it reaches the quality of fully-automated system, there is nearly no space for appreciating it as automatic disposition. Thus regulatory generalization of facial recognition for law enforcement purpose depends upon invasion or not against fundamental rights focused on human worth and dignity, which is judged with the constitutional criteria based on principle of rule of law in administration and principle of proportionality in proportion to technology advances and strengthened normal clarity. Therefore it is essentially important to stipulate for remote facial recognition dividing overall prohibition of real-time system and restrained grant of post system as referenced along to the Act of EU(European Union) on AI(artificial intelligence). Contrary to the former, the requisite of legitimate purpose focused on law enforcement is required for the latter with legal conditions materialized by applying warrant doctrine as due process of law and furthermore realizing principle of storage limitation and registry of personal data file with the procedure of prior impact assessment.
