Abstract
This article discusses current legal issues on whether and how to legalize facial identification information acquired through investigative surveillance using Facial Recognition Technology(hereinafter FRT). FRT contributes to crime investigation and crime prevention being notably utilized by investigation authorities in a variety of countries in order to monitor public places in an effort to arrest criminals and terrorists, or to prevent crime by automatically comparing still facial images captured from CCTV on the street comparing with lists of crime suspects in national databases. However, FRT causes a multitude of privacy issues by enabling investigative authorities to do dragnet surveillance in an open space. This article through a comparative research on the legal foundation of FRT in the United States, the U.K, and EU found that FRT is legally adopted when the original facial image was legally acquired meaning that the legality of converting facial images to facial recognition data depends on the acquirement procedure of the facial images. Unlike other countries, however, FRT in Korea raises two other legal issues. First, while the Korean national police agency maintains a database of facial images of all the citizen above 17years old under the related Act, a FRT database may violate the proportionality principle. Second, some facial images do not have not a legal basis.
