지능형 CCTV 운용에 따른 개인영상정보 보호의 쟁점

Abstract

Facial data is personal image data tracking the subject identified and far more learned by facial recognition system technologically operated by artificial-intelligent CCTV. And information retained by the system and combined easily with other information including personal location data is correspondent to personal data automatically collected as biometric recognition data which belongs to category of sensitive information specially regulated by personal information protection law. So natural person identified by facial data is subject to infringement of information privacy and right to privacy and so on. This treatise emphasizes the responsibility of public institution such as the state and local government. Then the principle of statute reserve and purpose constraint should be premised as retraced from the recent controversial cases like infringing and regulatory actions. In addition, this article points out that administrative notices, privacy impact assessment, and infringement factors evaluation should be made from a procedural point of view to minimize infringement on the rights with mandatory technical measures. Therefore it should be comfirmed that the risk control is established normatively against the social surveillance structure in the perspective of legislative system.
