Abstract

This study examines the evolving legal discourse surrounding inter-Korean relations following North Korea’s recent proclamation of a hostile “Two-State Theory,” and proposes a renewed legal framework for institutionalizing inter-Korean economic cooperation. While Article 3 and Article 4 of the Constitution of the Republic of Korea, along with the Inter-Korean Relations Development Act and the Inter-Korean Exchange and Cooperation Act, define inter-Korean relations as a provisional special relationship oriented toward peaceful unification, Pyongyang’s shift toward a sovereign state-to-state narrative generates constitutional, diplomatic, and international legal tension. The enactment of the Peace Economic Special Zone Act illustrates Korea’s attempt to institutionalize economic cooperation; however, its implementation requires careful alignment with constitutional territorial principles, WTO norms, global supply-chain regulations, foreign investor protection standards, and UN sanctions regimes. Existing legal structures—characterized by security-centered administrative control—have struggled to ensure predictability, reciprocity, and social legitimacy, resulting in weak policy sustainability. Accordingly, this article argues that any legal reform must rest on four foundational principles: constitutional coherence, international legal compatibility, institutionalized dispute-resolution mechanisms, and democratic legitimacy grounded in public consensus. By integrating constitutional mandates with pragmatic economic governance, this research provides a normative and policy-oriented framework for rebuilding inter-Korean cooperation while safeguarding national security, democratic accountability, and long-term unification policy objectives.
