본 연구에서는 학교설립과 경영 측면에서 다양한 공영형 혁신학교 모형을 탐색하고, 공영형 혁신학교 도입과 관련된 법적 쟁점을 검토하고자 한다. 최근 정부에서 도입하고자 하는 공영형 혁신학교는 현행 국공립학교와는 설립과 경영측면에서 대안적인 모형이 될 수 있다. 어떤 다양한 공영형 혁신학교 모형들이 있을 수 있는지를 검토하고, 다양한 모형들을 현장에 도입하는 데에 있어서 법적인 문제는 없는지, 어떤 모형이 법적으로 가능한지, 그리고 도입을 위해서는 어떤 법적 근거가 마련되어야 할 것인지를 검토하고자 한다. 이를 위해 정부의 공영형 혁신학교(안), 자립형 공립학교, 차터스쿨, 그리고 관련 선행 연구를 검토하여 설립과 경영 측면에서 기존 국공립학교 보다 다양한 학교유형을 탐색하였다. 그리고 이론적으로 탐색된 다양한 학교 모형들 중에서 법적인 관점에서 가능한 학교 설립 및 경영 주체 범위를 제시하고 이에 필요한 법적 근거 마련의 방안을 제안하였다.
Abstract
A study of investigating legal issues of ‘publicly financed innovative school' Kim, hyunjin(Kookmin University)The purpose of this study is to explore models of publicly financed innovative school and to investigate legal issues related with publicly financed innovative school. This study is expected to contribute providing possible models of the publicly financed innovative school for the government to develop diverse models. Also, this study can provide legal suggestions for the policy to be implemented successfully in the educational settings. For the purpose of this study, the model suggested by government, the model of publicly financed independent school, and charter school were reviewed and analytically compared. Diverse publicly financed innovative school models, in terms of school founders, were explored. In terms of school managers, corporations such as educational foundation, nonprofit corporation, public service corporation can be entrusted with the right to operate publicly financed innovative school. However, school council is not evaluated as legally appropriate manager of publicly financed innovative school.
