사립학교법제에 관한 기초 연구

Abstract

The Private School Law amended in 2005 has exposed critical conflicts in Korean society. The basic aim of this study is to present a theoretical base for solution of critical conflicts on The Private school Law through various research approach in educational law. And it targets to assign tasks to following study on legislative system related to private schools. The contents of this study are as follows. First, this study analyzes the fundamental meanings and characters on legislative system related to private schools. Second, it investigates the process of amendment of the legislative system related to private schools. Third, it demonstrates the reality of law recognition and possibility of judicial guarantee of the Constitutional Court by studying its judicial precedents regarding freedom of private school education. Finally, it examines the arguments of theories regarding the legal state of private school, the character of private school education, the legislative system related to private schools.
