Abstract
Decision(November 29th 2001) of "constitutional discord" by the Constitutional Court of Korea towards the Act on the Immigration and Legal Status of Overseas Koreans of 1998 resulted a hot debate again on the Korea's policy of the Koreans abroad, particularly to the Korean-Chinese. According to the decision, the legal provision excluding Korean-Chinese who moved to China before 1948 and their descendants from receiving legal benefits is unconstitutional and the provision will remain effective only through 2003. The Act grants various benefits to overseas Koreans while staying in Korea and the right to get jobs and do business in Korea. China expressed her deep concern on the Act. Soon, the issue of the Korean-Chinese became a diplomatic dispute between two countries. This paper discusses four points; firstly attitude of the Korean government towards the issue, secondly logical grounds of China's deep concern on the issue and contradiction of them, thirdly policy alternatives for better cooperative relations, and finally a suggestion of Sino-Korean Agreement on the Korean-Chinese. Through this, the paper shows that China's involvement on the Korean-Chinese is based on their invented concept of 'nation' and 'nationals.' And also, it shows how Chinese nationalism becomes a tool of diplomatic relations with Korea. In conclusion, the paper suggests Sino-Korean Agreement on the Korean-Chinese for better relations in the future.
