북대서양조약기구(NATO)와 국제연합(UN) 안보리와의 역학관계: 탈냉전 이후 나토의 집단안보 역할을 중심으로

1949년 4월 워싱턴 조약을 통해 탄생한 북대서양조약기구(NATO)의 역할은 외부의 침략으로부터 회원국의 안보를 책임지는 집단방위(collcetive defense)를 수행하는 것이었다. 그러나 냉전 종식 이후 나토의 주된 역할은 집단방위에서 집단안보 역할로 변하게 되었다. 그러나 특정 국가의 주권에 개입하게 되는 나토의 인도주의적 개입은 유엔 헌장 제7장하에서 유엔 안보리의 승인이 있어야 한다. 이런 맥락에서 볼 때, 냉전 종식 이후 나토가 집단안보 차원에서 인도주의적 개입 활동을 벌이고자 한다면, 그리고 그러한 행동이 특정 국가의 주권에 개입하는 경우라면, 나토는 유엔 안보리의 승인을 받아야만 하는가? 만약 나토가 무력사용에 대한 유엔 안보리의 승인없이는 집단안보 차원의 인도주의적 개입 활동을 할 수 없는 것인가? 만약 유엔 안보리의 승인 없이 나토의 집단안보 역할이 실행되었을 경우 국제사회는 이를 어떻게 규정해야 하는가? 필자는 이러한 문제의식을 가지고 탈냉전 이후 나토의 집단안보 사례 분석을 통해 합법성과 협력문제를 중심으로 나토와 유엔 안보리간의 역학관계를 분석하고자 한다.
Abstract
The North Atlantic Treaty Organization(NATO) was created for the purpose of collective defense in April, 1949. After the end of the Cold War, however, NATO has transformed its main security role from collective defense into collective security. Especially NATO's collective security role in the post-Cold War era was focused on humanitarian interventions that may have grave influence on state sovereignty. Therefore, more enlarged role for the NATO was closely related to United Nations' traditional task, commonly referred to as peacekeeping. Because the article VII in the UN Charter defines the use of force by the United Nations to uphold international peace and security, Big 5 of the 15 members of the Security Council have especially had the responsibility for authorizing humanitarian interventions until now. In this context this article examines NATO's humanitarian interventions toward Bosnia-Hercegovina, Kosovo, and Afghanistan and the relationship between its role and UNSC based on the three cases.
