Abstract
Following the founding of the Korean Communist Party in April 1925, the Japanese colonial authorities began suppressing the party, particularly after incidents such as the Sinuiju Incident in November 1925 and the June 10th Independence Movement in 1926. On September 13, 1927, a trial began in Korea targeting the Korean Communist Party, known as the “Case of the 101.” In Japan, a major crackdown on the Japanese Communist Party occurred in 1928, known as the “March 15 Incident.” The rapid rise of socialist movements both domestically and abroad led to the enactment of the Peace Preservation Law in May 1925 and its amendment under an emergency imperial ordinance in June 1928. In both Japan and colonial Korea, the increase in ideological incidents following the enactment of the Peace Preservation Law prompted plans to establish ideology prosecutor. As a result, in June 1927, Japan’s Ministry of Justice established the Ideological Division within its Criminal Affairs Bureau. Around the same time, Korean newspapers began reporting on the necessity of introducing ideological prosecutors. Finally, in December 1927, Ito Norio was appointed as an ideology prosecutor in the High Court Prosecutors’ Office in Korea, marking the birth of the first ideology prosecutor in colonial Korea. The High Court Prosecutors’ Office also established an “Ideological Division,” which published materials such as the Ideological Monthly Report[思想月報] and Ideological Bulletin[思想彙報], internally sharing information about the socialist movement in Korea, ideological cases under the Peace Preservation Law, court decisions, and statistics. This paper clarifies the duties and policy guidelines of ideology prosecutor based on regulations recorded in the Summary of Korean Ideology Prosecution It also reveals the concrete activities of ideology prosecutor through the writings and major cases handled by prominent prosecutors such as Ito Norio(伊藤憲郞), Moriura Fujio(森浦藤郞), and Sasaki Hideo(佐佐木日出男). Furthermore, it confirms that ideological prosecutors were assigned to probation offices established after the promulgation of the Korean Thought Offenders’ Probation Decree These ideology prosecutors, through the enactment and enforcement of the Peace Preservation Law, established an ideological legal system in colonial Korea. This system served as a violent and repressive apparatus designed to suppress and control individuals’ thoughts and ideologies, ultimately aiming to turn them into “loyal imperial subjects” of Japanese imperialism. The ideology prosecutor under Japanese colonial rule, who served as agents of oppressive and violent control mechanisms, reemerged in post-liberation Korean society as ‘ideology prosecutor’ driven by an anti-communist ideology. From the 1960s onward, they were further reproduced as public security prosecutors in charge of cases involving the National Security Law and espionage.
