경찰의 정보활동과 관련하여 경찰법 제3조와 경찰관 직무집행법 제2조 제4호는 치안정보의 수집･작성 및 배포를 경찰의 임무로 규정하고 있다. 그러나 경찰작용에 대한 일반법인 경찰관 직무집행법은 이 규정 외에 정보활동을 구체적으로 규율하는 내용은 거의 두고 있지 않다. 이와 같은 상황에서 현행 법규정에 따른 경찰의 정보활동에 대해서는 여러 논란이 있다. 경찰이 정보활동을 수행하는 것이 옳은 것인지, 현행 치안정보의 수집･작성 및 배포 규정에 의한 정보활동의 대상과 범위가 어디까지인지, 이 규정으로 기본권 침해적인 정보활동이 가능한 것인지와 같은 의문이 있어 왔고, 사회 일부 구성원으로부터는 이 규정에 근거한 경찰의 정보활동이 남용되어 국민의 기본권을 훼손하거나 정치적으로 오용되고 있다는 비판도 제기되어 왔다. 이 글은 이러한 논란이 있는 경찰의 정보활동 임무가 경찰관 직무집행법에서 어떻게 규율되고 어떠한 의미를 갖는지를 밝히는 데에 그 목적이 있다. 이를 위하여 이 글은 정보활동에 있어서의 임무와 임무규범, 외국 경찰법제에서의 정보활동 임무 현황, 치안정보의 수집·작성 및 배포 규정의 내용과 문제점 등에 대하여 살피고 있다. 외국의 법제로는 대륙법계와 영미법계의 대표적 국가인 독일과 프랑스, 그리고 영국과 미국에 대해서 일별한다. 치안정보의 수집·작성 및 배포와 관련하여서는 특히 치안 및 치안정보의 개념, 공공의 안녕과 질서 유지 임무와의 관계를 중심으로 검토하고 있다.
Abstract
In relation to the information activities of the police, Article 3 of the Police Act and Article 2 of the Police Officer's Duty Execution Act stipulate the collection, creation and distribution of public safety information as the mission of the police. However, the Police Officer's Duty Execution Act, which is a general law on police action, has little content that specifically regulates information activities. In this situation, there are various controversies about the information activities of the police under the current law regulations. There are questions such as whether it is right for police to carry out information activities, what the object and scope of information activities under the collection, creation and distribution of public safety information are, and whether this regulation makes rights-infringing information activities possible. And some members of society have the criticism that the information activities of police based on this regulation are abused and undermine the basic rights of the people or are being misused politically. This paper aims to clarify how the police intelligence mission is regulated and what it means in the Police Officers' Duty Execution Act. For this purpose, this paper examines the meaning of the mission and mission norms in information activities, the status of information activities in foreign police laws, and the contents and problems of the provision of collection, creation and distribution of public safety information. As for foreign legislation, the police laws in Germany, France, Britain and the United States, which are representative countries of continental law and Anglo-American law, are examined. In relation to the collection, creation and distribution of public safety information, this review focuses on the concept of public safety and public safety information, and its relationship to the mission of maintenance of public peace and order.
