Abstract

This study examined the impact of citizens' perceptions of the justice system as a whole on their sense of obligation to comply with the law and their law-abiding behavior. Unlike Tyler (1990), which treated the sense of obligation to comply with the law and legitimacy as the same concept, this study assumed that the sense of obligation to comply with the law is a consequence of the perception of legitimacy. In addition, following Tankebe's (2013) suggestion, we defined the concept of legitimacy to include four conceptual elements of procedural fairness, distributive fairness, effectiveness, and the rule of law. In our analysis of 3,400 responses from the 2021 National Survey of Public Opinion on Law, we found that the four conceptual elements of legitimacy have a statistically significant and positive relationship with a sense of obligation to obey the law and law-abiding behavior: the higher a citizen perceives the legitimacy of the justice system as a whole, the more likely he or she is to feel obligated to obey the law, even if it is to his or her detriment, and the more likely he or she is to actually obey the law. This relationship between perceived legitimacy and law-abiding behavior was mediated by a sense of obligation to obey the law. Specifically, the relationship between procedural fairness and law-abiding behavior was fully mediated by a sense of obligation to abide by the law, while the relationship between the remaining legitimacy factors and law-abiding behavior was partially mediated by a sense of fractional obligation to the law. The findings of this study suggest the need for policies to improve perceptions of legitimacy across the justice system in order to influence citizens' law-abiding behavior at a general level.
