Abstract

Diversion is a disposition that takes into account the developmental characteristics of juvenile offenders, but as it is an exceptional measure for criminal responsibility, clear standards and grounds are required. Since 2005, the police have been implementing the expert participation system (hereinafter the ‘expert participation system’) in the investigation of juvenile offenders as a procedure for diversification of juvenile offenders. Although the expert participation system has been receiving positive evaluations in related fields, it is undergoing changes such as the participation rate varies depending on the period. In this study, the intention of juvenile offenders to participate in the system is important in order to implement the expert participation system for intervening with juveniles at the police level, and we tried to identify the factors that influence this. For this purpose, among 279 data collected with the help of the school police officer (SPO) in charge of juvenile offenders charged with criminal cases, data on 169 cases, excluding 110 cases with no response, were analyzed. Variables affecting the participation intention of juvenile offenders were divided into two factors: individual characteristics and police officers' solicitation methods, and the effects of each factor and the variables were confirmed through a hierarchical regression analysis. As a result, individual characteristics factors such as gender, age, school attendance, and participation experience did not affect the juvenile offender's intention to participate. It was found that this influences the intention to participate. In particular, it was confirmed that police officers' solicitation aggressiveness and understanding of juvenile offenders' procedures were significant factors. Based on the research results, a plan to expand and implement the expert participation system was proposed.
