Abstract
Starting from the direct translation of Japanese law, Korea's 「Police Officer Duty Execution Act」 has been changed from various perspectives, including procedural security, proper processing of information, and facilitation of job execution through 16 practical revisions. Discussions on systematic reorganization are still actively underway, focusing on detailed risk concepts and introduction of general authorization provisions to further cope with security challenges. In addition to the special security environment, there are several factors different from Korea (Japan: Hereinafter, reverse capitalism), such as low barriers to legislation, diversity of public opinion convergence systems, and a thick group of researchers, but on the other hand, both Korea and Japan are similar in terms of the rule of law, human rights, and legal systems, and they also include a number of common tasks such as relational crimes, sex crimes, drugs, foreign crimes, and international terrorism, so discussions and legal practice in Korea can be used to solve problems in Korea (Japan). Amid the rapid change in the security environment, transparent discussions are required based on neighboring countries' experiences as the Japanese rigid law, which was 76 years ago, is reviewed before it fell into institutional fatigue.
