Abstract

This study empirically examines the unique characteristics of the “dine-and-dash” provision under the Minor Offenses Punishment Act by analyzing enforcement data from the Daejeon Metropolitan Police Agency between 2018 and 2023. Unlike other minor offenses, dine-and-dash involves an unusual legal structure wherein state authority intervenes in the failure of a private transaction. As a crime linked to the primal human need for food, it is strongly influenced by economic factors. Based on this premise, the study explores factors affecting the fine payment rate and investigates the relationship between the dine-and-dash provision and socially vulnerable groups. A one-way analysis of variance (ANOVA) was conducted focusing on the eight most frequent enforcement categories, revealing statistically significant differences in fine payment rates among offense types. Notably, the dine-and-dash category had the lowest payment rate. In addition, dine-and-dash cases exhibited the highest number of offender deaths before fine payment, suggesting a potential concentration of socioeconomically disadvantaged individuals among violators. These findings indicate the need for a welfare-based policy approach beyond mere law enforcement. Policy implications include the potential repeal of the dine-and-dash provision, selective handling of cases through minor offense adjudication committees, and the expansion of the Crime Victim Protection Act to cover small business owners harmed by dine-and-dash incidents.
