Abstract

This study explores the legal and cultural implications of Keiichirō Hirano’s concept of “dividualism” by comparing the legal systems and underlying views of personhood in South Korea and Japan. While modern law has traditionally been grounded in the notion of a fixed, autonomous individual (individualism), Hirano challenges this premise by proposing that the self is not unified, but rather composed of multiple “dividuals” that emerge in relation to others. This perspective raises fundamental questions about the construction of legal responsibility and identity. In Japan, legal institutions and social norms are largely aligned around individualistic assumptions, whereas in Korea, despite the persistence of relational, Confucian-based cultural practices, the legal system continues to reflect Western individualist models. By analyzing Hirano’s literary and philosophical texts, and applying the concept of dividuals to fields such as consumer law, family law, and constitutional law, this paper reconsiders legal responsibility, autonomy, and identity formation. The findings suggest that dividualism offers a more flexible and ethically attuned framework for rethinking legal personhood. It provides a theoretical lens for narrowing the gap between legal norms and lived realities and contributes to the ongoing reconfiguration of East Asian legal cultures.
