롤즈의 정의론에 관한 철학적 고찰: 윤리적 측면과 인식론적 측면을 중심으로

본 논문의 목적은 현대의 대표적인 정의에 관한 이론인 롤즈의 정의론(The Theory of Justice)을 비판적으로 고찰하는 것이다. 본 논문에서 집중적으로 검토하고자 하는 것은 롤즈 이론의 규범적 정당성과 인식론적 정당성이다. 정의와 관련된 규범적 기준에서 볼 때 롤즈의 이론은 모든 사회체제에 보편적으로 적용가능한 정의의 원칙을 구성하고자 하는 자신의 기획의도와는 윤리적인 측면에서 한계를 보인다. 롤즈의 정의의 원칙은 개인들 간의 자발적인 선택과 노력이라는 자유의지에 기반을 둔 불평등은 최소수혜자의 이익이라는 조건에 근거하여 부당하게 적극적인 대응을 보이는 반면 개인의 자유로운 선택을 제한하는 불평등한 사회-환경적 요인에 대해서는 단순히 기회의 평등이라는 소극적인 대응만을 보인다. 뿐만 아니라 롤즈가 기획하고 있는 정치와 경제가 분리된 사회는 기본적인 경제적 불평등에 대한 고려가 전제되지 않는 한 자유주의적 보수주의로 귀결될 가능성이 농후하다. 이와 같은 롤즈 이론의 규범적 한계는 롤즈 이론이 근거하고 있는 인식론적 결점으로부터 기인하는 것이다. 롤즈가 정의의 원칙을 도출하기 위해 사용하고 있는 절차적 정의는 그 자체로서 객관적으로 정의로운 객관적 방법론이라기보다는 자신이 비판하고 있는 직관주의적 전제에 일정정도 의존하고 있다. 또한 롤즈의 정의론이 전제하고 있는 인간관은 자유롭고 평등한 칸트적 인간관이다. 인간에 대한 칸트주의적 가정들은 실제 현실사회와는 괴리가 있는 비현실적인 전제 위에 기초하고 있다고 비판된다. 현실사회에서 실제 인간은 롤즈가 전제하고 있는 인간관과는 달리 정치적, 경제적 자원의 불균등과 부족으로 자율적이고 합리적인 결정을 하기 힘든 조건에 있다는 것이다. 롤즈의 정의론이 가진 기본구상을 효과적으로 달성하기 위해서는 다음의 몇 가지 점들이 보완되어야 할 것이다. 첫째, 사회내의 상대적 불평등 정도에 반응하고 이를 시정할 수 있는 기제가 롤즈의 정의론 체계에 보완되어야 할 것이다. 둘째, 개인의 선호와 자유의지에 대한 존중과 아울러 사회적, 구조적 불평등 요인을 억제할 수 있는 기제를 갖추어야 한다. 셋째, 한 사회에 적절한 사회정의론에 대한 구상이 본질적으로 선험적이거나 보편적이라기보다는 자유와 평등에 대한 사회구성원들의 집합적 문화의 산물이라는 것을 고려할 때 한국적 적용을 모색하기 위해서는 롤즈 정의론이 적용될 수 있는 문화적 선결조건들에 대한 점검이 우선적이다.
Abstract
The main purpose of this paper is to examine the philosophical aspects of Rawls's theory of Justice, which has been considered as the most important work in the academic field of social justice. The focus of the paper is a critical examination on normative and epistemological validity of Rawls's scheme of justice. The paper reports that Rawls's theory has failed to sufficiently meet the validity requirements to be a universal and objective scheme of justice. First, in regard to normative validity, Rawls's theory shows some internal inconsistencies within the structure of its' justice principles. While Rawls's theory overreact to the individual free select and efforts through the MAXIMIN principle of difference principle, it does not offer any active interventions to social and structural conditions which are likely to limit the scope and extent of individual selection rather than guarantee the equality of opportunity. Second, in regard to epistemological aspects, Rawls's theory shows some performative contradictions not only in the methodology from which the principle of justice is derived, but also in the assumption about the subject of social contract, which is based on the Kantian notions of subject. Rawls used the procedural justice as his main methodology of justice-building, however, it shares the same epistemological problems with intuitionism which he criticized as transcendental. Rawlsl's basic understanding of human being which is based on Kantian paradigm is characterized as liberal, neutral, and individualistic, which is both redundant and contradictory. Therefore it is suggested that Rawls's theory needs to take steps to strengthen it's own ideas to combine liberty and equality.
