롤즈(Rawls)의 도덕이론에 대한 비판적 고찰

“사상체계의 제1덕목을 진리라고 한다면 정의는 사회제도의 제1덕목이다”라는 롤즈(Rawls)의 '정의론'의 구절은 그의 도덕이론의 출발점이라 할 수 있다. 롤즈는 정의의 원칙을 토대로 하는 새로운 도덕이론 체계를 세웠다고 볼 수 있다. 연구자는 공정으로서의 정의, 합리성과 선, 정의감, 도덕심리학을 중심으로 롤즈의 도덕이론 구조의 틀을 정리하면서, 롤즈의 도덕이론이 전통적 의미의 의무론적 윤리학, 보편주의적 전통을 계승하고 있음을 확인하면서 이에 대한 공동체주의의 비판과 여성주의 윤리학을 중심으로 비판적으로 고찰하였다. 양자의 비판에서 주요한 공통점은 보편주의에 근거한 롤즈의 도덕이론이 탈맥락적이고 차이에 대한 이해를 결여하고 있다는 것이다. 하지만 롤즈의 후기 저작을 통해서 이러한 비판이 일부분 오해와 잘못된 이해에서 비롯된 것임을 설명하였다. 하지만 도덕원리의 기초가 정의의 원칙에 출발하고 있는 롤즈의 도덕이론은 보편주의에 대한 비판에서 자유로울 수는 없을 것이다. 아울러, 보편성과 차이를 결합시키려는 하버마스(Habermas)와 벤하비브(Benhabib)의 담론윤리, 호네트(Honneth)의 인정도덕이론을 살펴봄으로써 롤즈 도덕이론과 비판이론들이 다원화된 사회에서 진일보한 도덕이론을 재구성할 수 있는 이론적 기제가 될 수 있음을 확인할 수 있었다.
Abstract
This thesis focused on Rawls’ moral theory with reference to his works 『A Theory of Justice』, 『Political Liberalism』. The aim of thesis was to examine Rawls’ theory in the critical perspective with reference to critics and I will seek new ethics beyond Kant’s Ethics. In chapter two, I analyzed his moral theory already mentioned Rawls’ theory of justice. Especially, I tried to examine the moral theory on Rawls’ Justice, focusing on ‘justice as fairness’, ‘rationality and good’, ‘sentiment of justice and moral psychology. Then we understood Rawls’ moral theory which was based on universalism in moral theory. Moreover, we could grasp the person as antecedently individuated or unencumbered, priority of right over good, and developmental stages in sentiments of justice. The content of chapter three reviewed Rawls’ theory in terms of communitarianism, virtue ethics and feminist ethics focused on ‘conception of ego’, ‘priority of right’ and ‘gender’. In addition, I explained Rawls’ response of these criticisms on the Political Liberalism. From those explanation, we could grasp the critics about Rawls’ theory that was due to understanding between universality and difference. In chapter four, I studied the discourse ethics in moral theory with reference of Benhabib and Habermas, they agreed to universality, however they recognized that it was important to admit difference in plural society. While Honneth suggested that it was possible for us to form of moral of recognition which was consisted of communitarianism, caring ethics, and Kant’s ethics. In conclusion, Rawls’ theory was applicable to the reality and futhermore enchanced the new framework of moral theory, today.
