정의론과 정의 지향의 문제 - 롤즈(J. Rawls)에 대한 비판적 검토를 중심으로 -

이 글에서 나는 정의론에서 정의를 향하도록 1인칭의 관점에서 동기를 부여하는 동적 계기라는 문제를 주제화 하고자 하였다. 이를 위하여 롤즈 이론으로부터 동적 계기의 문제가 정의론을 평가하는 중요한 요소가 되어야 한다는 점, 그럼에도 불구하고 롤즈가 이 문제를 소홀히 한 점을 지적하였다. 나아가 동적 계기의 관점에서 보았을 때, 롤즈의 정의론은 인간관에서 최선의 정의관이 되는 데 문제를 노출하고 있음도 살펴보았다. 그리고 이 문제는 옳음에 앞선 선의 우선성, 즉 타인의 선에 대한 책임이라는 선으로부터 정의관이 도출될 때 해결될 수 있을 것임을 주장하였다.
Abstract
In this paper, I tries to thematize the problem of the so called 'dynamic moment' in the theory of justice that motivates each person with the first person view to orient himself or herself toward the ideal state of justice. My point is that the problem of the dynamic moment should be regarded as a element in assessing a theory of justice, and that Rawls pays no attention to the element in his theory of justice, even worse, his conception of the person causes a serious trouble regarding the dynamic moment. I conclude that the problem of Rawls' theory can be solved, only when a conception of justice is drawn from the good of the responsibility for others, in other words, the priority is laid on the good over the right.
