본 논문에서는 존 롤스의 정의이론에서 기본 구조 개념이 차지하는 중요성을 살펴보고, 동시에 이 개념이 제시되는 방식에 대해 비판적 고찰과 보완적논의를 제시하려 한다. 나는 정의 원칙의 대상이 되는 기본 구조가 어떻게 설정되고 있는지, 다시 말해 롤스에게서 주제화되는 사회 구조란 무엇인지, 이들은 정의 원칙에 의해 어떻게 규제되는지, 그리고 왜 이렇게 특별한 이론적 대상으로서 규정되고 있는지를 우선 설명한다. 뒤이어 롤스의 기본 구조 개념에 제기된 오킨의 비판을 논의하고, 이를 롤스적 관점에서 대답할 수 있는지를 검토한다. 마지막으로 나는 앞서 살펴본 롤스의 기본 구조 논증이 왜 이러한 비판을 받게 되었는지, 이를벗어나기 위해 어떤 보완점이 필요한 것인지를 지적하고자 한다.
Abstract
In this article, I emphasize the role of ‘basic structure’ in Rawls’ theory, and suggest a critical view of the way the concept is presented. First, I provide an overview of Rawls’ argument regarding the ‘institutional division of labor,’ which explains the meaning of social structures, how they are regulated by the principle of justice, and why these structures have such a significance in his theory of justice. Secondly, I review a criticism of Rawls’ concept of basic structure by Susan M. Okin, then I examine whether his argument can be defended in a consistent way. I believe that the way his concepts are conceived has a flaw, which could be addressed by expanding the definition of social structures.
