장애인 사회보장수급권의 실효성 변천 - 1963년부터 2008년까지의 소득보장 영역을 중심으로-

한국의 장애인 사회보장제도는 급속히 도입되어 2008년 현재 많은 제도들이 시행되고 있다. 그럼에도 불구하고 장애인 소득보장 수준은 매우 낮아 장애인 가구 빈곤율은 비장애인 가구 빈곤율의 6배에 육박한다. 이러한 문제의 원인을 규명하기 위해 장애인 사회보장수 급권의 실효성을 소득보장 영역 중심으로 살펴보았다. 이를 위해 ‘장애인 사회보장수급권 실효성 기준’을 분석틀로 하여 관련 법률에 종단으로 적용하였다. 분석 결과 최소소득보장, 장애연금, 장애수당 정책의 장애인 사회보장수급권의 실효성 수준은 급여대상, 급여구성, 급여제한, 권리구제라는 각 영역별로 차이가 존재하였다. 이러한 연구 결과는 이 후 장애인 소득보장 정책을 어떻게 변화시켜야 할 것인가에 대한 구체적인 입법지침을 제공하는데 기여할 것이다.
Abstract
Though social security for people with disabilities has been introduced, level of social security for people with disabilities is very low and poverty rate of people with disabilities is 6 times of it of people without disabilities. This study attempts to examine standards on the effectiveness of the rights to social security of people with disabilities and it focuses on income security policy, in order to fine out causes of this problem. Standards on the effectiveness of the rights to social security of people with disabilities is framework of this study, it is applies to related laws in historical. The results show that levels of standards on the effectiveness of the rights to social security of people with disabilities makes a difference between public assistance, disability pension and disability allowance in areas of benefit coverage, benefit structure, benefit restriction and rights relief. The results will provide concrete legislation guides to change income security policies for people with disabilities.
