아동학대 사망사건의 생존 형제자매는 어떻게 보호되고 있는가?

How Are Surviving Siblings of Fatal Child Maltreatment Protected?

본 연구는 2019년 아동학대로 사망한 아동들의 기록을 추적하여 생존한 형제자매들의 특성을 규명하고, 이들에 대한 보호 및 서비스제공 현황은 어떠한지 분석하였다. 이를 위해 국가아동학대정보시스템을 통하여 2019년 학대로 사망한 아동들의 생존 형제자매 31명의 일반적 특성과 아동보호전문기관의 사례관리 현황을 살펴보고, 개별적인 신고접수, 학대 여부 판단 및 서비스 제공, 추후 모니터링 등이 이루어졌는지, 즉 최소한의 사례관리가 이루어졌는지 분석하였다. 분석 결과, 사망사건이 발생한 후 생존 형제자매에 대하여 학대 판정이 이루어질 수 있도록 별도로 학대의심 신고를 접수시킨 아동은 전체 31명 중 12명(38.7%)에 불과하였다. 서비스 제공 내역을 확인한 결과, 가장 많은 비중을 차지하는 영역은 아동 안전점검 및 상담서비스였다. 생존 형제자매의 경우 사망사건의 목격 등 심리적 트라우마가 심각할 것으로 예상되지만 아동보호전문기관에서 직접 제공하는 심리치료 및 의료지원 서비스는 부족한 것으로 나타났다. 마지막으로 생존 형제자매를 단순히 사망아동의 가족으로만 관리하거나 서비스제공이 거의 없었던 8명(25.8%)의 생존아동에 대하여는 아동보호전문기관에서 최소한의 사례관리도 이루어지지 않았다고 판단하였다. 이러한 연구 결과는 학대 사망아동의 생존 형제자매를 ‘학대 피해자’로서 인식해야 한다는 점과 이들에 대한 보다 적극적인 보호와 사례관리가 필요함을 시사한다.

Abstract

This study aims to examine the characteristics of the surviving siblings of fatal child maltreatment. Further, the study analyzes how child protective services(CPS) involve with the siblings after child maltreatment fatalities. For this purposes, we examined the case management records of CPS for the 31 siblings of 42 children died as a results of child maltreatment in 2019 through analyzing the data from the National Child Abuse Information System. The study results revealed that child protection agencies filed a report of suspected maltreatment after the maltreatment fatalities for only 12 (38.7%) among the 31 siblings. The minimum safety assessments have not conducted properly for the siblings without the filed reports. The analysis of case management records for the siblings showed that services provided for the children were mainly safety checks/counseling. Further, the records indicated the lack of personalized services and medical support services. Finally, the study found that many surviving siblings were treated only as family members of the dead children, but not as child abuse victims in the CPS. For these reasons, it is revealed that no minimum services and CPS involvements were provided to 8 (25.8%) among the 31 surviving siblings. Based on the study findings, we suggest that protective authorities should recognize the surviving siblings of child abuse fatalities as ‘abuse victims’, not just as family members. In addition, more case management efforts are needed for the children who experienced the child abuse deaths of siblings.
