이 글의 목적은 홉스의 저항권 이론을 세가지 관점에서 분석하고, 이에 근거하여 고등학교 사회과 교과서 및 교사용 지도서에 나타난 개념적 오류를 개선하고자 하는 것이다. 홉스의 저항권을 이론을 분석하기 위하여 세가지 관점에서 접근하였다. 첫째, 절대주권을 인정하고 저항권을 인정하지 않는 칼 슈미트의 관점 둘째, 자연법론의 관점에서 저항권을 인정하는 관점 셋째, 절대주권과 저항권을 동시에 인정하는 관점이다. 분석결과 홉스는 저항권을 인정하였음을 알 수 있었고, 이를 토대로 저항권에 대한 오개념을 서술한 교과서의 문제를 지적하였다.
Abstract
This paper attempts to analyze the right of resisting in Leviathan. And I investigate the relationship between absolute sovereign authority and resistance. There are three main perspectives on this topic. First, Hobbes was a supporter of absolute sovereign authority. So he could not agree on the resistance theory. Second, Hobbes was a natural law thinker. And his resistance theory is defensible if it is properly understood. Third, in Leviathan subjects have to obey the sovereign. But at the same time they have inalienable rights of self-defense. I analyzed those perspectives and argued that Hobbes’ argument for the right of resisting is consistent.
