금융상품이 점차 복잡하고 다양해지면서 금융소비자보호 문제도 사회적인 이슈로 부각되어왔다. 금융소비자보호의 강화는 금융회사의 경쟁력을 제고하고 더 나아가 금융산업의 발전에기여할 수 있다. 거시적인 관점에서 금융소비자보호 체계의 강화가 금융 및 경제의 안정성에도 기여할 것이기 때문에 보다 장기적인 관점에서 금융소비자보호 체계의 강화를 도모해야 한다. 이에 금융소비자보호 제도 전반에 대한 문제점과 개선방안을 제시하는 데 본 연구의 목적이 있다. 본 논문에서는 금융소비자보호의 필요성을 소개하고, 사전적 금융소비자보호 제도와 사후적 금융소비자보호 제도 및 문제점에 대해 살펴보았다. 그 중 특히 금융소비자보호의 가장 이슈가 되는 제도의 문제점을 밝히고 구체적인 개선방안을 제시하였다
Abstract
Purpose : Since the reinforcement of the financial consumer protection system will also contribute to financial and economic stability, it is necessary to strengthen the financial consumer protection system from a longer-term perspective. The purpose of this study is to present problems and improvement measures for the overall financial consumer protection system. Research design, data, methodology : Based on previous studies, a literature study was conducted on the financial consumer protection system. Results : The preliminary financial consumer protection system and the post financial consumer protection system were introduced. Among them, the problems of the system, which is the most important issue of financial consumer protection, were investigated and concrete improvement measures were suggested. Conclusions : The Financial Consumer Protection Act requires revisions such as the punitive damage compensation system, the conversion of the burden of proof, and the introduction of the class action system. An efficient management plan that can improve the effectiveness and reliability of financial education contents must be prepared. It is necessary to consider ways to improve the effectiveness of the dispute mediation system, such as enhancing the efficiency of civil service and introducing a single-sided binding force.
