이글에서는 동물의 도덕적 지위 문제를 살펴본다. 이 문제는 육식, 동물실험 등과 같은 실천적인 문제와 직결된다. 동물의 도덕적 지위에 대한 입장은 1) 이것을 전적으로 부정하는 입장 2) 원리적으로 인간과 동등하게 인정하는 입장, 3) 제한적으로만 인정하는 입장으로 구분할 수 있다. 이글은 넓은 반성적 평형의 방법을 통해서 세 번째 입장을 정당화하고자 한다. 넓은 반성적 평형은 숙고된 도덕판단, 도덕원칙, 배경이론들간의 정합성을 추구하는 방법이다. 이것은 연역주의와 결의론과는 달리 배경이론의 역할을 인정함으로써 사회의 변화와 발전에 탄력적으로 대처할 수 있다는 장점이 있다. 특히 그것은 실천윤리학에서 요구되는 사회과학 및 자연과학의 연구성과를 흡수하기에 용이하다. 동물의 지위를 제한적으로 인정하자는 입장은 도덕이론과 관련해서는 차별적 생명가치론과 계약주의의 지지를 받는다. 그리고 생태학과 진화론 등의 배경적 사실에도 잘 들어맞는다는 점에서 반성적 평형 상태에 도달한다.
Abstract
This article deals with the moral standing of animals. The issue directly relates to the legal, practical subjects such as animal experiment and eating meat. There are three views on the moral standing of animals. 1) denying the standing 2) approving the equal standing with human 3) approving the standing restrictively. I would like to justify the third view. Wide reflective equilibrium is the method to try to get the coherence among the considered moral judgments, moral principles, and background theories. It has an advantage in that it can very well cope with the social change compared to the rival theories such as deductionism and casuisty. Also, it can absorb the outcomes of social science and natural science into itself through background theories. Approving the standing restrictively gets the support of the moral theories such as contractarianism. And it arrives at the reflective equilibrium with the background theories such as evolutionary theory and ecology.
