환경철학을 위한 ‘목적론적 자연법’전통- 아리스토텔레스와 아퀴나스의 사상의 재평가 관점에서 -

본 연구는 서양철학에서 오랜 사유의 전통을 형성해왔던 ‘목적론적 자연법’의 전통을 되살려서, 현대의 환경철학 담론에 적용하기 위한 시도이다. ‘목적론적 자연법’의 전통은 서양 고대의 아리스토텔레스에 의해 정립된 목적론적 이론에 뿌리를 두고서, 서양 중세의 토마스 아퀴나스에 의해 강한 생명력을 지닌 사상 체계로 발전한 사상의 전통이다. 본 논고에서, 논자는 이러한 ‘목적론적 자연법’ 전통이 오늘날 환경철학을 위한 담론들의 사상적 기초를 형성하고 있음을 찾아내고 의미화하고자 한다. 이런 의미에서 본 연구는 ‘목적론적 자연법’ 전통의 현대적 구제라 할 수 있다. 이 관점에서 본 연구는 우선, ‘목적론적 자연법’ 전통의 사상적 가치를 새롭게 발굴하는 차원에서 1) 목적론과 자연법의 조화, 2) 자연적 경향성에 대한 긍정적 논변, 3) 양지에 기초한 양심 개념의 현대적 의미 성찰을 중심주제로 아리스토텔레스와 아퀴나스의 사상을 재평가 한다. 아울러, 본 논고는 서양 근대 시기에 이르러 자연권 개념의 등장과 더불어 ‘목적론적 자연법’ 사상의 전통이 변형된 문제를 비판적으로 고찰한다. 결론에 이르러 논자는 ‘오래된 옷’이 단지 ‘낡은 것’이라는 단순한 비판적 태도를 벗어나서, 인간과 자연의 올바른 관계의 회복을 위해 ‘목적론적 자연법’ 전통의 현대적인 가치 발견의 가능성과 필요성을 강조한다.
Abstract
This study is an attempt to revive the tradition of ‘teleological natural law’, which has formed a long tradition of thinking in Western philosophy, and apply it to contemporary environmental philosophy discourse. The tradition of ‘teleological natural law’ is a tradition of thought that developed into a system of thought with strong vitality by Thomas Aquinas in the Western Middle Ages, rooted in the teleological theory established by Aristotle in ancient times. In this paper, the author seeks to find and signify that this ‘teleological natural law’ tradition forms the theoretical basis of today’s discourses for environmental philosophy. In this sense, this study can be said to be a modern salvation of the ‘teleological natural law’ tradition. From this perspective, this study first focuses on 1) harmony between teleology and natural law, 2) positive argument for natural tendencies, 3) concept of conscience and expansion of modern meaning in order to discover the theoretical value of the ‘teleological natural law’ in tradition Aristotle and Aquinas’s thoughts. In addition, this paper critically examines the transformation of the tradition of ‘teleological natural law’ with the emergence of the concept of ‘natural rights’ in the Western Modern Ages. In conclusion, the author goes beyond the simple critical attitude that the ‘old clothes’ is just the ‘outdated’, and actively emphasizes the possibility of discovering the modern value of the ‘teleological natural law’ tradition for the restoration of the right relationship between humans and nature.
