(Natural law is the rational creature’s participation in the eternal law)’’에 관한 문제를 제기했는데, 이에 대해서는 존 피니스(John Finnis)의 “metalepsis”와 “participatio"라는 용어에 대한 설명을 중심으로 반론을 제시할 것이다.
Abstract
The aim of this study is to show that the theory of natural law of St. Thomas is not an apparent harmony with the theory of Aristotle but a developmental synthesis which is the most ideal embracement when two different doctrines met. To do this I will say the relation between the theory of St. Thomas and that of Aristotle whom he was absolutely influenced by. In regard to the relation between the theory of the natural law of St. Thomas and that of Aristotle, some people have positive attitude and the others have negative one. Jaffa(Harry Jaffa) who is the representative one of the latter, as Macintyre(Alasdair Macintyre) says, is the most persuasive theorist. Jaffa argues against a harmony by St. Thomas and criticizes his the apparent harmony because in his theory of the natural law there is a clear trend of ‘falsely harmonizing’ Christianity with Aristotelian doctrines. I will consider three issues on the theory of the natural law of St. Thomas that Jaffa referred and make a conclusion through counterargument as follows. Firstly, on the physics and the natural moral precept I will suggest Macintyre’s functional view as a counterargument to seemingly ‘naturalistic fallacy’ which Jaffa criticised that it seemed to exist in the theory of Aristotle and St. Thomas. Secondly, on natural law and eternal law I will argue against Jaffa’s objection to “Natural law is the rational creature’s participation in the eternal law.” by a meaning of “metalepsis” and “participatio" which Finnis(John Finnis) explained. Lastly, on natural habit in moral principles I will argue against Jaffa’s viewpoint through three ways, the study on texts of Aristotle and St. Thomas, a meaning of “habitus” of Kenny(Anthony Kenny), and arguments of Kenny and Stevens(Gregory Stevens). Thus I will bring a matter to light that the theory of natural law of St. Thomas is not only an apparent harmony with Aristotle’s theory, but is a most ideal type of acceptance to pursue, the type of developmental synthesis when two other scheme come across.
