이 논문은 현대 독일철학자인 로베어트 슈패만의 자연법 사상과 생태계 윤리사상을 소개하려고 한다. 그의 사상은 주로 아리스토텔레스의 윤리학과 정치철학 사상에 의거하여 전개된다. 자연, 자연법, 목적론등의 주요개념을 축으로 하여 이루어지는 그의 윤리사상은 서양 근세 이후에 등장하여 현대에까지 영향을 미치는 기능주의에 반대한다. 그 이유는 기능주의적 사유방식이 인간과 자연 사회의 본질을 잘 못 이해하여, 결과적으로 인간존엄성과 생태계의 파괴를 초래하기 때문이다. 슈패만은 근대사상에 뿌리를 둔 무한진보의 사상과 과학주의에도 반대하면서 우려를 표명한다. 오늘날 절실히 요구되는 것은 근대성에 대한 비판적 성찰과 생태계 윤리의 건설이다. 그러기 위해서는 새로운 자연법을 구상함으로써 그에 대한 이론적 토대를 마련해야 한다. 슈패맨은 만물의 존재의 근원을 해명하는 종교(그리스도교)를 강조한다. 따라서 윤리학은 형이상학적(metaphysical) 존재론적(ontological) 바탕을 가져야 한다.
Abstract
The present paper aims to present Robert Spaeman's thoughts on natural law and eco-system ethics. His thoughts are mainly based on Aristotelian ethics and politics. Spaeman's ethics may be explained through such key concepts as nature, natural law, and teleology. Spaeman rejects functionalism which has been exerting its influence on the West ever since the advent of modern age. The main reason for his objection lies in the fact that such a functionalistic view with its misunderstanding about the essence of human beings, nature and society, is likely to bring about the loss of human dignity and the destruction of the eco-system. Spaeman also expresses his concerns regarding scientism and the idea of an unlimited progress, which are both strong in modern thinking. Accordingly, it is thought that there is an urgent demand for the critical evaluation of modernity in general and the establishment of ecological ethics. This implies that there is a need for a new understanding regarding natural law and its theoretical foundation. Spaeman highly stresses the importance of the role of religion (Christianity) which attempts to explicate fundamental truths about all beings. In this sense, for Spaeman ethics needs to be anchored on metaphysical ontology.
