본 연구는 임시정부와 임시의정원의 관계 속에서 임시대통령 탄핵 절차를 정리하는 데 목적이 있다. 이 과정은 임시정부의 임시대통령 탄핵의 전체 과정을 살펴보는 것이면서 임시대통령 탄핵 연구의 기초를 닦는 작업에 해당한다고 할 수 있다. 임시정부는 임시의정원을 거쳐 이승만을 임시대통령직에서 탄핵･면직시켰다. 임시의정원은 먼저 ‘탄핵의 사전 단계’로서 ｢불신임안｣을 가결하였다. 다음으로 ‘탄핵의 본 단계’로서 ｢임시대통령 탄핵안｣을 의결함으로써, 임시헌법의 절차에 따라 임시대통령을 심판한 것이다. 임시대통령 탄핵 이후, 임시정부는 지도체제를 변경하고자 임시헌법을 개헌하였다. 지난 6년간 ‘대통령제’로 임시정부를 운영하면서 적지 않은 문제가 드러났기 때문이다. 이러한 문제를 해결하기 위해 ‘내각책임제’로 바꾸려고 하였다. 제2대 임시대통령으로 취임한 박은식은 임시헌법을 개정･공포하였다. 3개월 뒤에 개정 헌법이 시행되기까지 인선 작업을 마무리하고 스스로 임시대통령직에서 물러났다. 이처럼 국가의 지도자가 역사적 과제를 인식하고 그것을 해결하려는 자세는 한 지도자로서 중요한 의미가 있다. 이는 대한민국 임시정부의 초대 임시대통령 탄핵 연구가 가지는 의의라고 할 수 있을 것이다.
Abstract
The purpose of this study is to organize the impeachment process of the interim president in the relationship between the interim government and the interim assembly. This process looks at the entire process of the interim presidential impeachment by the interim government and can be said to be a work that lays the foundation for the research on the impeachment of the interim president. The Provisional Government impeached and dismissed Syngman Rhee from the Provisional Presidency through the Provisional Assembly. The Provisional Assembly first passed the ｢No-Confidence Plan｣ as a 'pre-stage of impeachment'. Next, by voting on the ｢impeachment of the Provisional President｣ as the 'main stage of impeachment', the Provisional President was judged according to the procedure of the Provisional Constitutional. After the impeachment of the interim president, the interim government amended the of the Provisional Constitution to change the leadership system. This is because a number of problems have been revealed while running the provisional government under the "presidential system" over the past six years. To solve this problem, the leadership system was changed to a 'cabinet responsibility system'. Park Eun-sik, who took office as the second interim president, revised and promulgated the of the Provisional Constitution. Three months later, he completed the selection process until the revised constitution came into force and resigned from the temporary presidency. As such, the attitude of a country's leader to recognize historical tasks and solve them is of great significance as a leader. This can be said to be the significance of the study of the impeachment of the first interim president of the Provisional Government of the Republic of Korea.
