임시의정원·임시정부의 권위가 제헌헌법· 정부수립에 미친 정치적 영향에 대한 고찰

1919년 3·1운동과 연결되는 임시의정원과 임시정부의 헌정주의와 민주공화주의 정신은 해방이후 1948년 제헌헌법을 만들고 대한민국 정부를 수립하는 과정에서도 지켜졌을까? 어느 정도로 지켜졌을까? 이런 질문을 던지는 이유는 이른바, ‘건국절 논쟁’이 나온 진영간의 인식차이와 갈등 때문이다. 이런 ‘건국절 논쟁’이 나오게 되는 배경에는 1919년 3·1운동과 연결되는 임시의정원과 임시정부의 헌정주의와 민주공화주의 정신이 해방이후 1948년 제헌헌법을 만들고 대한민국 정부를 수립까지 일관되게 이어지고 있다는 점을 제대로 설득하지 못하거나 서로 인식을 공유하지 못하기 때문으로 보인다. 본 글의 목적은 미국의 공화주의 혁명과 건국모델의 헌법적 토대인 ‘헌법제정권력의 권위’에 대한 한나 아렌트의 시각을 기초로 하는 헌정주의와 민주공화주의 정신의 관점을 수용하여 1919년 3·1운동과 연결된 임시의정원과 임시정부가 1948년 제헌헌법과 정부수립에 미친 정치적 영향에 대해 살펴보는 데 있다. 즉 1919년 탄생한 임시의정원과 임시정부의 정치적 권위가 1948년 제헌헌법과 그에 따라 탄생한 대한민국 정부수립에 미친 영향과 의미에 대해 살펴보고자 한다.
Abstract
Was the constitutionalism and democratic republican spirit of the Provisional Assembly and the Provisional Government, which was connected with the March 1st Movement in 1919, been preserved in the process of establishing the Constitutional Constitution in 1948 and establishing the Government of the Republic of Korea after liberation? To what extent was it kept? the reason for asking such a question is the difference in perception and conflict between the camps where the so-called “Foundation Day debate” came out. in the background of this 'Foundation Day debate', the constitutionalism and democratic republican spirit of the Provisional Assembly and the Provisional Government connected with the March 1st Movement in 1919 were consistently established after the liberation of the Constitutional Constitution in 1948 and the establishment of the Korean government. It seems that it is because they cannot properly convince them that they are continuing, or they cannot share their perceptions with each other. the purpose of this article is to accept the spirit of constitutionalism and democratic republicanism based on Hannah Arendt's view of the constitutional foundation of the American Republican Revolution and the constitutional foundation of the constitutional foundation of the constitutional power of constitutional government, and the view of its realization in 1919. The purpose of this study is to examine the political impact of the 1948 Constitutional Constitution and government establishment by the Provisional Assembly and the Provisional Government linked to the March 1st Movement. in other words, I would like to examine the effects and implications of the provisional legislature and the political authority of the provisional government established in 1919 on the Constitutional Constitution in 1948 and the establishment of the Korean government.
